CITY OF NORTH OLMSTED RESOLUTION NO. 2019 - 19 By: Mayor Kennedy A RESOL UTIONA UTHORIZING THE DIRECTOR OF PUBLIC SAFETY TO PURCHASE A SUTPHEN SPH 100 LADDER TRUCK, AT AN ESTIMATED COST OF 51,228,833.66 FROM SUTPHEN CORPORATION, THROUGH THE STATE PURCHASE PROGRAM, AND FURTHER AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS NECESSARY TO EFFECTUATE SUCH PURCHASE, AND DECLARING AN EMERGENCY. WHEREAS, the North Olmsted Division of Fire needs to acquire a new ladder truck; and WHEREAS, the Director of Public Safety recommends that the City acquire this vehicle, at an estimated cost of $1,228,833.66, from Sutphen Corporation, as qualified by and through the State Purchasing Program; and WHEREAS, it is the desire of this Council to authorize the Mayor to purchase said vehicle, through the State Purchase Program, as a permitted exception to the competitive bidding procedure that otherwise would be required for such expenditures, and to further authorize the Mayor to execute any documents required for such expenditure, including, subject to approval of the Board of Control, if necessary, a contract with the lowest and best bidder selected among State qualified vendors. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to purchase through the State Purchasing Program, which was established by R.C. Section 125.04, and which the City is authorized to participate in pursuant to the City Charter and Resolution No. 87-6, one (1) new Sutphen SPH 100 platform ladder truck and related equipment for this vehicle, all of which is described in the specifications on file in the Safety Department. If necessary to effectuate any such purchase through the State Purchasing Program, the Mayor is hereby authorized to execute any contract and/or other necessary documents required by the authorized vendor(s), the State of Ohio, or the Charter. Any contract executed by the Mayor shall be in a form and substance consistent with the provisions of this Resolution and approved by the Director of Law. See Exhibit A, Quote for Vehicle, attached. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Resolution go into effect immediately because it will take between eleven (11) and thirteen (13) months for delivery after the order is placed; and
