SECTION 6: That in the event any such property owner shall fail, neglect or refuse to <br />construct and repair any such sidewalks hereinbefore specified in accordance with the plans and <br />specifications on or before June 15, 2019, the City Engineer be, and hereby is, authorized and <br />directed to cause each such sidewalk to be constructed or repaired in accordance with this <br />Resolution and to make and return to Council the cost and expense thereof. The entire cost of <br />such work, which said lots and lands are hereby determined to be specifically benefited by said <br />improvements, shall be assessed on the tax duplicate of the lot and lands bounding and abutting <br />on the sidewalk needing construction or repair. The cost of such improvement shall include, but <br />not be limited to, the cost of preliminary and other surveys, plans, specifications, profiles and <br />estimates, the cost of printing, serving, and publishing notices, resolutions and ordinances, the <br />cost of all special proceedings, the cost incurred in connection with the preparation, levy and <br />collection of special assessments, legal expense, the cost of labor and materials and other <br />necessary expenditures. <br />SECTION 7: That upon the City's completion of the construction and repair of the <br />sidewalks as provided in this Resolution, the City Engineer is hereby authorized and directed to <br />ascertain the total cost of such construction and repair along with a list of estimated assessments <br />against each abutting lot and parcel of land which shall be placed on file in the Office of the <br />Clerk of Council and be available for public inspection. <br />SECTION 8: That the Clerk of Council or his designee be, and hereby is, directed to <br />cause written notice of passage of this Resolution to be served upon the owners of the lots or <br />lands abutting upon the sidewalks to be constructed or repaired, as such are specified in Exhibit <br />A, in the manner provided and required by Ohio Revised Code section 729.03. <br />SECTION 9: That this Resolution is declared to be an emergency measure immediately <br />necessary for the preservation of the public health, safety and welfare in that the repairs to the <br />sidewalks referred to herein are urgently required for the safety and protection of the citizens of <br />the City of North Olmsted and for the further reason of affording property owners ample time <br />during building season to make such repairs, therefore this Resolution shall take effect and be in <br />full force immediately upon passage. <br />PASSED: I,7��� <br />A TTEST: <br />'CHARLES MASSAROLO II <br />Clerk of Council <br />First Reading: <br />Second Reading: <br />Third Reading: <br />Committee: Sof S �7r, nSpr�� <br />T <br />NICOLE DA#EYO <br />President of Council <br />
