CITY OF NORTH OLMSTED RESOLUTION NO. 2019 - 21 By: Mayor Kennedy A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO A CONTRACT WITH MAD BOMBER FIREWORKS PRODUCTIONS TO PROVIDE A FIREWORKS DISPLAY FOR THE 2019 NORTH OLMSTED FOURTH OFJULYCELEBRATION, AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted, in the 1970's and 1980's, had a long tradition of orchestrating a 4`h of July fireworks celebration and fostered a sense of community pride and served as a family friendly way to celebrate the holiday; and WHEREAS, to celebrate the City of North Olmsted's bicentennial, foster pride and provide a tamily friendly way to celebrate the 4th of July weekend i n2015, community pride successful fireworks celebration was held in North Olmsted, to the delight of many; and and WHEREAS, additional. equally successful events were staged in 2016, 2017 and 2018; WHEREAS, Mayor Kennedy proposes to have a fireworks celebration in North Olmsted again in 2019; and WHEREAS, it is the recommendation of the Director of Planning and Development that the City enter into a contract with Mad Bomber Fireworks Productions to provide a fireworks display for the 3011, of June, 2019. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into an agreement with Mad Bomber Fireworks Productions to provide a fireworks display for the City of North Olmsted for the 30t1, of June, 2019. The contract shall be in form and substance substantially similar to the attached Mad Bomber Productions Agreement, marked as Exhibit A, and attached hereto, with such changes to be hereinafter made in said contract as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. SECTION 2: That this Resolution shall take effect and be in force from and after the earliest date provided for by law following its passage and approval by the Mayor.
