CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2019 - 27 <br />BY: Mayor Kennedy <br />AN ORDINANCE ACCEPTING A TRAFFIC CONTROL <br />EQUIPMENT EASEMENT LOCATED ON PROPERTY OWNED BY <br />NORTH OLMSTED CITY SCHOOLS BOARD OF EDUCTION AND <br />DESIGNATED AS PERMANENT PARCEL NUMBERS 235-16-007 <br />AND 235-16-008 BY CUYAHOGA COUNTY MAPS AND RECORDS, <br />AND DECLARING AN EMERGENCY <br />WHEREAS, North Olmsted City School District, Board of Education (School <br />Board), a political subdivision, in consideration of just compensation, has offered a <br />Permanent Easement to the City of North Olmsted for Right of Way to support <br />installation of Traffic Control Equipment, as shown by the Consolidation Plat, a copy of <br />which is attached as Exhibit 1; and <br />WHEREAS, additional right of way in support of the traffic signalization project <br />is needed for public road improvements to be installed in the area adjacent and parallel to <br />Butternut Ridge Road at Dover Center Road as part of the North Olmsted Signals Phase 2 <br />Project; and, the location of which is shown by Exhibit 1; and <br />WHEREAS, this Council desires to obtain from said owner a temporary <br />construction and permanent easement for installation, operation and maintenance of said <br />Traffic Control Equipment Easements, as situated on a portion of Permanent Parcel <br />Number 235-16-007 and 235-16-008; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OFNORTH OLSMTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to accept, on behalf of the <br />City of North Olmsted, an Easement for Permanent Right of Way, as necessary for <br />Traffic Control Equipment, from North Olmsted City School District, Board of <br />Education, an Ohio political subdivision, the owner of certain real property located along <br />the south side of Butternut Ridge Road at Dover Center Road and known as part of <br />Permanent Parcel Number 235-16-007 and 235-16-008. The Easement area, which the <br />Mayor is authorized to accept on behalf of the City, is documented by the Consolidation <br />Plat, a copy of which is attached as Exhibit 1. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed <br />to cause said easement to be recorded in the Office of the Cuyahoga County Fiscal <br />Officer. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health, safety and <br />
