CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2019 - 31 <br />By: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO PURCHASE A NEW <br />2019 DISC STYLE BRUSH BANDIT CHIPPER FROM KRYSTOWSKI <br />TRACTOR, AT A COST OF $60,378.56 THROUGH A STATE <br />COOPERATIVE PURCHASE PROGRAM, AND FURTHER AUTHORIZING <br />THE MAYOR TO EXECUTE ALL CONTRACT DOCUMENTS, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the Director of Public Service recommends that the City acquire one (1) <br />new 12" Disc Style Brush Bandit Chipper for use within the Department of Public Service, from <br />Krystowski Tractor, at a cost of $60,378.56, as priced through a cooperative purchasing program <br />authorized by the State of Ohio; and <br />WHEREAS, Revised Code Section 9.48 provides for such Cooperative Purchasing <br />Program, as an exception to competitive bidding limitations imposed by Revised Code Section <br />307.86, and the City of North is a participating member of Sourcewell I Cooperative Purchasing <br />Program (formerly NJPA), in accordance with the Charter; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to purchase said <br />Chipper through the Sourcewell I, Cooperative Purchasing Program (formerly NJPA) and to <br />further authorize the Mayor to execute any contract documents required for such expenditure. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to purchase through the <br />State Cooperative Purchase Program, specifically Sourcewell I Cooperative Purchasing Program <br />(formerly NJPA), which is recognized by R.C. 9.48 as an exception to the competitive bidding <br />limitations in R.C. 307.86, and which the City is authorized to participate in pursuant to the City <br />Charter and Resolution No. 87-6, one (1) new 2019 12" Disc Style Brush Bandit Chipper, at a <br />cost of $60,378.56, from Krystowski Tractor, all of which is described in the quote on file in the <br />Service Department. The Mayor is hereby authorized to execute any contract documents with <br />vendors and, as necessary, to effectuate the State Cooperative Purchase Program through <br />Sourcewell I (formerly NJPA). Any contract executed by the Mayor shall be in a form and <br />substance consistent with the provisions of this Resolution and be approved by the Director of <br />Law. <br />SECTION 2: That this Resolution shall take effect and be in force from and after the <br />earliest period allowed by law. <br />
