CITY OF NORTH OLMSTED RESOLUTION NO. 2019 - 54 BY: Mayor Kennedy A RESOLUTION DECLARING THE NECESSITY OF THE CONSTRUCTION AND REPAIR OF CERTAIN SIDEWALKS IN THE CITY OF NORTH OLMSTED BY THE ABUTTING PROPERTY OWNERS, THE CONSTRUCTION, REPAIR, AND ASSESSMENT OF THE COSTS OF SIDEWALKS IN CERTAIN CASES BY THE CITY, AND DECLARING AN EMERGENCY WHEREAS, the City of North Olmsted City Council desires to establish a sidewalk repair program in the City of North Olmsted; and WHEREAS, the Ohio Revised Code (Chapter 729) and North Olmsted Charter authorize the City to require Owners to construct and repair sidewalks abutting their property: and WHEREAS, if the abutting property owner does not perform the necessary construction and repairs, the City may make the necessary repairs and assess on the property owners' tax duplicate such construction and repair costs. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STA TE OF OHIO: SECTION 1: That Council approves the plans, specifications, and estimate of cost for the proposed construction and repair of the sidewalks as are on file in the Office of the Clerk of Council located at 5200 Dover Center Road, North Olmsted, Ohio 44070. SECTION 2: That the list of lots and lands abutting upon the sidewalks to be constructed or repaired are described by street address and further identified on Exhibit A which is attached hereto and made a part hereof. SECTION 3: That the owners of said described lots and lands abutting such sidewalks, shall construct and repair the sidewalks in accordance with the plans and specifications on file in the Office of the Clerk of Council. SECTION 4: That the owners of said described lots and lands shall construct and repair the sidewalks abutting their lots and lands on or before June 15, 2019. SECTION 5: That in the event such sidewalks are not constructed and repaired by the owners of the lots and lands abutting thereon in accordance with such plans and specifications and within the time prescribed in this Resolution, the City of North Olmsted will so construct and repair Such sidewalks and assess the cost thereof against the lot and lands abutting thereon.
