CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2019 - 56 <br />By: Mayor Kennedy and Councilperson Schumann <br />AN ORDINANCE ACCEPTING A DEED FROM KIWANIS CLUB OF <br />NORTH OLMSTED DONATING LAND TO THE CITY OF NORTH <br />OLMSTED, AS AMENDED. <br />WHEREAS, the Executive Board of the Kiwanis Club of North Olmsted, having <br />considered its ownership of a triangular shaped parcel of land, located with frontage on the <br />northern side of Butternut Ridge Road, immediately east of and adjacent to the I-480 overpass, <br />and determined to offer this real property to the City of North Olmsted as generous donation of <br />real estate; and <br />WHEREAS, the City has undertaken a preliminary title search to both identify the parcel <br />and to ensure that the land is free of liens or encumbrances; and <br />WHEREAS, the City has communicated with Cuyahoga County officials to address the <br />creation of Permanent Parcel Number 235-06-044 for this donated land and to verify the legal <br />description for same; and <br />WHEREAS, it is the desire of this Council and the Administration to gratefully accept <br />the land hereinafter described as a generous donation from the Kiwanis Club of North Olmsted. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: Contingent upon approval by the Director of Law, this Council does <br />hereby authorize the Mayor to accept a deed of conveyance from the Kiwanis Club of North <br />Olmsted, conveying the property described on Exhibit A, attached hereto and incorporated herein <br />as if fully rewritten. <br />SECTION 2: That the Mayor is directed to receive and record said deed. <br />SECTION 3: That the Clerk of Council is directed to correspond with Kiwanis Club of <br />North Olmsted, conveying gratitude and appreciation of the Council and the Administration for <br />the land conveyed to the City. Further, Kiwanis Club of North Olmsted's contribution of the <br />property to the 000 ofNorth Olmsted will be recognized on signage at the park. <br />SECTION 4: The property will be improved consistent with the City's Gateways Plan, <br />to consist of passive pocket park with a tie into the historic district. <br />SECTION 5: Kiwanis will be invited to participate in plannin_a to refine the details of <br />the park improvements. <br />
