CITY OF NORTH OLMSTED ORDINANCE NO. 2019 - 56 By: Mayor Kennedy and Councilperson Schumann AN ORDINANCE ACCEPTING A DEED FROM KIWANIS CLUB OF NORTH OLMSTED DONATING LAND TO THE CITY OF NORTH OLMSTED, AS AMENDED. WHEREAS, the Executive Board of the Kiwanis Club of North Olmsted, having considered its ownership of a triangular shaped parcel of land, located with frontage on the northern side of Butternut Ridge Road, immediately east of and adjacent to the I-480 overpass, and determined to offer this real property to the City of North Olmsted as generous donation of real estate; and WHEREAS, the City has undertaken a preliminary title search to both identify the parcel and to ensure that the land is free of liens or encumbrances; and WHEREAS, the City has communicated with Cuyahoga County officials to address the creation of Permanent Parcel Number 235-06-044 for this donated land and to verify the legal description for same; and WHEREAS, it is the desire of this Council and the Administration to gratefully accept the land hereinafter described as a generous donation from the Kiwanis Club of North Olmsted. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: Contingent upon approval by the Director of Law, this Council does hereby authorize the Mayor to accept a deed of conveyance from the Kiwanis Club of North Olmsted, conveying the property described on Exhibit A, attached hereto and incorporated herein as if fully rewritten. SECTION 2: That the Mayor is directed to receive and record said deed. SECTION 3: That the Clerk of Council is directed to correspond with Kiwanis Club of North Olmsted, conveying gratitude and appreciation of the Council and the Administration for the land conveyed to the City. Further, Kiwanis Club of North Olmsted's contribution of the property to the 000 ofNorth Olmsted will be recognized on signage at the park. SECTION 4: The property will be improved consistent with the City's Gateways Plan, to consist of passive pocket park with a tie into the historic district. SECTION 5: Kiwanis will be invited to participate in plannin_a to refine the details of the park improvements.
