CITY OF NORTII OLMSTED <br />ORDINANCE. NO. 2019 - 59 <br />By: Mayor Kennedy <br />AN ORDINANCE ESTABLISHING A NEW AND REGYSED FEE <br />SCHEDULE FOR PARTICIPATION IN THE CITY'S C:O L41UVITY <br />DI VERSIO.,N PROGRAM ("CDP') AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of'North Olmsted Community Diversion Program presently charges <br />program fees for participation in juvenile delinquency proceedings; and <br />WHEREAS, those fees have not been revised since 2006; and <br />WHEREAS, the program fees for participation are proposed to range from $80.00 to <br />$120.00. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF C117YAHOGA, AND STATE OF OHIO: <br />SECTION 1: That there is hereby established a program fee of between eighty dollars <br />($80.00) to one hundred twenty dollars ($120.00) for cases of delinquency and unruly children to <br />be charged to the parent or other guardian of each juvenile who participates in the Community <br />Diversion Program of the Division of Youth and Family Services. In addition to this fee, each <br />said parent or guardian of a jrn-enile, who violates [lie Program"s guidelines and is filed upon in <br />Juvenile Court within one year of his or her admission to the program for delinquency and unruly <br />cases and within ninety (90) days for tobacco and traffic violations, shall pay an administrative <br />fee which shall be no less than twenty-five dollars ($25.00) and no greater than one hundred <br />dollars ($100.00). Said administrative fee in each case shall be determined by the Administrator <br />of the Division of Youth and Family Services, who shall base it upon the severity of the violation <br />committed. All fees provided for herein, which are collected by the Administrator of the <br />Division of Youth and Family Services, shall be used exclusively for Division of Youth and <br />Family Services programming, including, but not limited to, programs and interventions and <br />operating expenses for youths and families involved in community diversion. <br />SECTION 2: That any Ordinance or parts of Ordinances inconsistent with or in conflict <br />with this Ordinance, to the extent of any such inconsistency or conflict with this Ordinance, be <br />and hereby are repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason it is necessary that this legislation go into effect immediately in order that the City <br />may promptly adjust programming fees in order to offset continued costs of service and further, <br />provided it receives the affirmative vote of two-thirds of all members of the Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor. <br />
