THIS LICENSE AGREEMENT (the "Agreement") is made and executed at North
<br />Olmsted, Ohio, by and between the City of North Olmsted, an Ohio municipal corporation
<br />(hereinafter, "Licensor"), whose main office is located at 5200 Dover Center Road, City of North
<br />Olmsted, Ohio 44070, John and Julia Treska, residing at 29151 Dorchester Road, City of North
<br />Olmsted, Ohio 44070 and the Bretton Ridge Homeowners Association, care of Jon Jarc, its
<br />President, located at 6357 Stafford Drive, North Olmsted, Ohio (collectively "Licensee"), as
<br />follows:
<br />RECITALS
<br />A. For the purpose of, among other things, safety of the motoring public and the
<br />maintenance of public utilities and streets, Licensor has exclusive authority to regulate the use of
<br />property that falls within the public right of way, inclusive of property between the sidewalk and
<br />the paved portion of the roadway located at 29151 Dorchester Road, City of North Olmsted, Ohio
<br />("Licensor's Right of Way").
<br />B. Licensee Treska are the owners of a certain parcel of land located at 29151
<br />Dorchester Road, City of North Olmsted, Ohio "(Licensee's Property").
<br />C. Licensee Bretton Ridge Homeowners Association seeks to construct an
<br />identification sign for its development within Licensor's Right of Way and upon Licensee's
<br />Property.
<br />NOW, THEREFORE, for good and valuable consideration, the receipt and
<br />sufficiency of which are mutually acknowledged, the parties hereby agree as follows:
<br />1. Licensor grants to Licensee Treska and Licensee Bretton Ridge
<br />Homeowners Association a license to use Licensor's Right of Way for construction of a "Bretton
<br />Ridge/Cambridge Crossings" sign, as identified on the attached Exhibit A.
<br />2. Licensee Treska, in turn, grant to Licensee Bretton Ridge Homeowners
<br />Association a license to use Licensee's Property for construction of a "Bretton Ridge/Cambridge
<br />Crossings" sign, as identified on the attached Exhibit A.
<br />3. Notwithstanding the licenses granted herein, Licensor's Right of Way shall
<br />continue to be regulated and restricted as to usage and construction of improvements therein by
<br />Licensor and Licensor may use, maintain, make repairs to and replace improvements within
<br />Licensor's Right of Way, in whole or in part at any time, without unreasonable disruption of
<br />Licensees' permitted uses.
<br />4. Licensee Bretton Ridge Homeowners Association agrees that it shall use
<br />Licensor's Right of Way and Licensee / Licensor Treska's Property and exercise its rights
<br />hereunder at its sole risk, cost and expense. Licensee Bretton Ridge Homeowners Association
<br />agrees for itself and its agents, employees, successors and assigns, to use Licensor's Right of Way
<br />in common with Licensor and its employees and agents and further agrees that it shall not obstruct
