CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2019 - 74 <br />BY: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE DONATION OF SURPLUS <br />AND VACANT REAL PROPERTY TO THE CLEVELAND <br />METROPARKS, SPECIFICALLY PERMANENT PARCEL NOS. 233- <br />18-028, 233 -IS -035, AND 233-19-039, WHICH WERE ACQUIRED BY <br />AND THROUGH THE NORTH OLMSTED LAND REUTILIZATION <br />PROGRAM (LAND BANK), SUBJECT TO REVIEW AND APPROVAL <br />BY THE DIRECTOR OF LAW AS TO FORM, AND FURTHER <br />AUTHORIZING THE MAYOR TO EXECUTE ANY REQUIRED <br />DOCUMENTA TIONAND DEEDS OF CONVEYANCE. <br />WHEREAS, since May 21, 2013, as approved by Ordinance No. 2013-50, the City of <br />North Olmsted established a land reutilization program and has participated in Cuyahoga <br />County's effort to recover tax delinquent homes and vacant parcels through foreclosure; and <br />WHEREAS, these vacant parcels are located in a wooded area near the Bradley <br />Woods Reservation, as shown by Parcel Map attached as Exhibit A, and were offered to the <br />City of North Olmsted's land bank because, at the time, the Cleveland Metroparks' land bank <br />was not yet operational; and <br />WHEREAS, the administration finds that there are no public uses for these vacant <br />parcels of property and that reutilization by the Cleveland Metroparks would serve the public <br />interest, so the City accepted the parcels in anticipation of the Metorparks' ability to accept <br />this donation; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Director of <br />Law, together with the Planning and Development, to work with the Cleveland Metroparks to <br />transfer title to these vacant parcels, from the City's land bank to the Metroparks' land bank, <br />and to further authorize the Mayor to enter into any Deeds of Conveyance or other <br />documentation to affect same; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Law, together with the Director of Planning and <br />Development, are hereby authorized to prepare and record necessary conveyance forms, <br />including Deeds, to transfer surplus and vacant real property, specifically three (3) parcels <br />known as PPN 233-18-028, 233-18-035 and 233-19-039 (vacant parcels located generally in <br />the vicinity of Bradley Woods Reservation displayed by Exhibit A) to the Cleveland <br />Metroparks for nominal consideration and costs. <br />SECTION 2: The vacant parcels identified in Section 1 were acquired by the City of <br />North Olmsted pursuant to the Cuyahoga County land reutilization program, are not necessary <br />for any public purpose, and shall be transferred to the Cleveland Metroparks in accordance <br />with the Cuyahoga County land reutilization program standards. <br />
