CITY OF NORTH OLMSTED ORDINANCE NO. 2019 - 80 BY: Councilmember Williamson AN ORDINANCE AMENDING CHAPTER 557 OF THE GENERAL OFFENSES CODE OF THE CITY OF NORTH OLMSTED, ENTITLED "SALE OF CIGARETTES AND TOBACCO PRODUCTS TO MINORS," IN ORDER TO PROHIBIT THE SALE TO OR POSSESSION OF CIGARETTES, ELECTRONIC CIGARETTES AND VAPING DEVICES BY INDIVIDUALS UNDER 21 YEARS OFA GE, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, since 2001, the City Council has locally prohibited the sale, possession and use of cigarettes and other tobacco products by persons under the age of 18 years in the same manner as then new R.C. Section 2151.87; and WHEREAS, the State of Ohio has now adopted legislation to restrict the sale, possession and use of cigarettes and tobacco products by persons under the age of 21 years; and WHEREAS, it is the desire of Council to amend local legislation to include prohibition against persons under the age of 21 purchasing, using or possessing cigarettes, electronic cigarettes and vaping devices. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Chapter 557 of the General Offenses Code of the City of North Olmsted, "Sale of Cigarettes and Tobacco Products to Minors," which currently reads as set forth on Exhibit A, shall be amended and, as amended, shall read in its entirety as set forth on the attached Exhibit B. SECTION 2: That any Ordinance or parts of Ordinances inconsistent with or in conflict with this Ordinance, to the extent of any such inconsistency or conflict with this Ordinance, be and hereby are repealed. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and for the further reason that it is immediately necessary that this legislation go into effect immediately to mirror state law on a local level.
