CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2019 - 80 <br />BY: Councilmember Williamson <br />AN ORDINANCE AMENDING CHAPTER 557 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, ENTITLED "SALE OF CIGARETTES AND <br />TOBACCO PRODUCTS TO MINORS," IN ORDER TO <br />PROHIBIT THE SALE TO OR POSSESSION OF CIGARETTES, <br />ELECTRONIC CIGARETTES AND VAPING DEVICES BY <br />INDIVIDUALS UNDER 21 YEARS OFA GE, AND DECLARING <br />AN EMERGENCY, AS AMENDED. <br />WHEREAS, since 2001, the City Council has locally prohibited the sale, possession and <br />use of cigarettes and other tobacco products by persons under the age of 18 years in the same <br />manner as then new R.C. Section 2151.87; and <br />WHEREAS, the State of Ohio has now adopted legislation to restrict the sale, possession <br />and use of cigarettes and tobacco products by persons under the age of 21 years; and <br />WHEREAS, it is the desire of Council to amend local legislation to include prohibition <br />against persons under the age of 21 purchasing, using or possessing cigarettes, electronic <br />cigarettes and vaping devices. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Chapter 557 of the General Offenses Code of the City of North <br />Olmsted, "Sale of Cigarettes and Tobacco Products to Minors," which currently reads as set forth <br />on Exhibit A, shall be amended and, as amended, shall read in its entirety as set forth on the <br />attached Exhibit B. <br />SECTION 2: That any Ordinance or parts of Ordinances inconsistent with or in conflict <br />with this Ordinance, to the extent of any such inconsistency or conflict with this Ordinance, be <br />and hereby are repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the further <br />reason that it is immediately necessary that this legislation go into effect immediately to mirror state <br />law on a local level. <br />
