CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2019 - 97 <br />BY: Mayor Kennedy <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO A <br />LEASE AGREEMENT FOR LIMITED USE OF VACANT REAL <br />PROPERTY OWNED BY THE CITY, SPECIFICALLY PERMANENT <br />PARCEL NO. 235-12-010, L OCA TED A T5963 BURNS ROAD. <br />WHEREAS, the City of North Olmsted qualified for and participated in the Ohio <br />Emergency Management Agency (OEMA) Pre -Disaster Mitigation Grant program, funding <br />from which enabled the City to abate residential structures located at 5563 Burns Road and <br />the City then acquired ownership of Parcel No. 235-23-010 within a flood plain; and <br />WHEREAS, this City -owned vacant parcel remains subject to OEMA restrictions <br />against reconstruction, is not otherwise needed for public use, and qualifies to be leased for <br />purposes of gardening in this residential neighborhood; and <br />WHEREAS, the Lease attached as Exhibit A is supplied by and based upon OEMA <br />standards and regulations to enable a neighboring homeowner to plant a garden on the vacant <br />parcel, which Lease is subject to termination by the City if necessary, and relieves the City of <br />maintenance responsibilities for this vacant parcel; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter <br />into a Lease of vacant real property at 5563 Burns Road, consistent with the OEMA grant, and <br />to restore productive use of the parcel as a garden. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and is hereby authorized to enter into a Lease of <br />vacant real property, specifically parcel known as PPN 235-12-010 (vacant parcel located at <br />5563 Burns Road) under the terms and conditions of said Lease, a copy of which is attached <br />as Exhibit A, with resident Cody Kelly, whose address is 5577 Burns Road, North Olmsted, <br />OH 44070. <br />SECTION 2: The vacant parcel identified in Section 1 was acquired by the City of <br />North Olmsted pursuant to an Ohio Emergency Management Agency (OEMA) Pre -Disaster <br />Mitigation Grant, is not necessary for any public purpose, and remains subject to OEMA <br />restrictions on its use, which are preserved by the terms of said Lease, Exhibit A. <br />SECTION 3: That this Ordinance shall take effect and be in force from and after the <br />earliest date provided for by law. <br />PASSED: 06ceE(^ i6( <br />First Reading: 1--�_ /11' <br />Second Reading: 11-1157-1 <br />Third <br />/ --1 1 - <br />Third Reading: _/Z -3-/l <br />Committee <br />Z- - <br />Committee: r, lhne & <br />
