EXHIBIT <br />a <br />In <br />J <br />Q <br />LEASE AGREEMENT <br />This Lease is made effective this day of , 2019, between The City <br />of North Olmsted, whose address is 5200 Dover Center Road, North Olmsted, OH 44070 <br />("Landlord"), and Cody Kelly, whose address is 5577 Burns Road, North Olmsted, OH <br />44070 ( "Tenant"). <br />PREMISES. Landlord leases to Tenant, on the terms and conditions set forth below, the <br />premises located and described as follows (the "Premises"): 5563 Burns Road, North <br />Olmsted, OH 44070 PP#: 235-12-010. <br />The General Warranty Deeds to this property which are referred to as "the Premises," are <br />recorded (Reference #: 00337174) in the Deed Records, Cuyahoga County Recorder's Office, <br />Cuyahoga County, Ohio. The City of North Olmsted acquired the Premises pursuant to a "State - <br />Local Agreement" entered into by the City of North Olmsted, Cuyahoga County, Ohio and the <br />Ohio Emergency Management Agency dated July 18, 2018, the terms and conditions of which <br />are incorporated by reference into the Deeds for the Premises. The Deeds for the Premises <br />require the City of North Olmsted to maintain the Premises as open space in perpetuity in order <br />to protect and preserve the natural floodplain. Tenant hereby acknowledges and agrees to be <br />bound by the terms and conditions of the "State -Local Agreement" regarding use of the <br />Premises, by all deed restrictions in the above -referenced Deeds which are incorporated <br />herein by reference, and by CFDA 97.07. Tenant further acknowledges and agrees that the <br />Premises shall remain the property of the Landlord at all times, and that the leasehold <br />granted to the Tenant by this Lease shall revert in full to the Landlord in the event the <br />Tenant ceases to exist, the Lease is not renewed, or the Lease is terminated. <br />TERM. The term of this lease shall initially begin on the date the lease is fully executed and <br />expire on December 31st of the following calendar year. The lease shall then automatically <br />renew on an annual basis. Landlord or Tenant may terminate this Lease at any time and for <br />any reason, upon 30 days' written notice to the other party. <br />RENT. Tenant shall pay as rent for the Premises the sum of ($1.00) per year. The rent <br />shall be paid by January 15th of each year to Landlord at its address set forth above or at <br />such other place as Landlord may designate. If the rent is not paid within 5 days of the due <br />date, the rent shall be deemed late. <br />USE. Landlord leases the premises to Tenant for the purpose of gardening. The following is <br />a list of restrictions for the premises: Specifically, no permanent structures; no above ground <br />fences or any obstruction which would trap debris; no storage of any hazardous or toxic <br />materials, or any other use considered environmentally contaminating, dangerous, or a safety <br />hazard; no above or below ground storage tanks; no paved areas that include asphalt, <br />concrete, oil -treated soil or other material that inhibits floodplain functions; no placement of <br />fill except minimal amounts of gardening topsoil; and no -parking shall be permitted. This <br />list of non -permitted uses is intended to be by way of examples and is not intended to be an <br />exhaustive list. <br />1 <br />
