NORTH OLMSTED RECREATION DEPARTMENT g EXHIBIT 26000 LORAIN ROAD � NORTH OLMSTED, OHIO 44070 (440) 734-8200 PROGRAM / SERVICE PROVIDER AGREEMENT Carlie Jones, as an independent contractor ("Instructor"), will provide the following program / services for the North Olmsted Recreation Department: GROUP EXERCISE INSTRUCTOR. 2. Payment will be made on the following basis: Instructor shall receive Zero (0) Participants = $12.00 Instructor Pay Per Class One (1) or more Participants = $26.00 Instructor Pay Per Class As an independent contractor, any taxes associated with this income are the responsibility of the program/service provider. 3. The following facilities, equipment, supplies and services will be provided by the Instructor: Group Exercise. All equipment provided to Instructor by the City of North Olmsted Recreation Department shall remain the exclusive property of the City of North Olmsted and promptly shall be returned to the City of North Olmsted at the conclusion of this Agreement. Additionally, unused supplies provided to Instructor for use in performance of this Agreement shall be returned to the City of North Olmsted at the conclusion of the Agreement. 4. Customer identification including names, addresses and telephone numbers generated as result of providing service pursuant to this Agreement are the exclusive property of the City of North Olmsted. All documents indentifying in any way the customers to whom service is being provided are to be returned to the City of North Olmsted at the conclusion of this Agreement. 5. The above services must be completed to the satisfaction of the North Olmsted Recreation Department. The City of North Olmsted reserves the right, in its sole discretion, to terminate this Agreement at any time for any reason. This Agreement is non -assignable, unless agreed to in writing by the Mayor. In the event that this Agreement is terminated, Instructor shall be paid for services rendered to the date of termination. 6. If the contractor identified herein provides services directly to children at any of the City's Parks or Recreation facilities, then this contract shall be contingent upon the independent contractor, together with all subcontractors and employees designated by him, submitting to a criminal records check as required by Codified Ord. 131.03. This contract shall not be binding upon the City until the Parks and Recreation Commissioner shall have received the results of the records check and shall have deemed, in her/his sole discretion based upon the records check results, the contractor and his agents acceptable to perform the contract requirements. 7. As an independent contractor, you acknowledge that you are not eligible for benefits including, but not limited to, workers compensation coverage, vacation leave, sick leave, health insurance coverage and retirement benefits, including participation in the Ohio Public Employees Retirement System ("OPERS").
