CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2020 - 34 <br />By: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH THE CUYAHOGA COUNTY JUVENILE COURT TO <br />PARTICIPATE IN THE COURT'S COMMUNITY DIVERSION PROGRAM <br />TO ADDRESS JUVENILE'S CHARGED WITH MISDEMEANOR, STATUS <br />AND SELECT FELONY OFFENSES IN THE CITY OF NORTH OLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council desires to enter into an Agreement with the Cuyahoga County <br />Juvenile Court to participate in the Court's juvenile misdemeanor, status and select felony <br />offenses diversion program, and to provide for and enable the City to utilize the financial <br />assistance provided by said Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into an Agreement <br />with the Cuyahoga County Juvenile Court to participate in the Court's Community Diversion <br />Program sponsored by the Court for charged juvenile misdemeanor, status and select felony <br />offenses and to request financial assistance in connection with a Community Diversion Program <br />established by the Cuyahoga County Juvenile Court. Said contract shall be substantially in the <br />form of the "Community Diversion Program Agreement," marked as Exhibit "A" and attached <br />hereto, with only such changes therein as are not substantially adverse to the City and which are <br />approved by the Director of Law. The character of any such changes as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the agreement by the <br />Mayor and the approval of the agreement by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately to ensure a flow <br />of funds from the contract so as to not interrupt services for diversion; and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor. <br />PASSED: I�✓�, C I �I , ZOZD <br />First Reading. <br />Second Reading: 1 <br />Third Reading: 5�5Nn�ti <br />Committee: <br />
