($25.00) and no greater than one hundred dollars ($100.00). Said administrative fee in each case <br />shall be determined by the Administrator of the Division of Youth and Family Services, who <br />shall base it upon the severity of the alleged violation. All fees provided for herein, which are <br />collected by the Administrator of the Division of Youth and Family Services, shall be used <br />exclusively for Division of Youth and Family Services programming, including, but not limited <br />to, programs and interventions and operating expenses for youths and families involved in <br />community diversion. <br />SECTION 3: The Program will continue to use a volunteer magistrate who shall be an <br />attorney at law licensed to practice law in the State of Ohio. <br />SECTION 4: The Administrator of the Division of Youth and Family Services is hereby <br />authorized to establish such rules, procedures and regulations as are necessary to effectuate and <br />achieve the objectives of the local Community Diversion Program and the Juvenile Traffic <br />Intervention Program. Nothing in this Ordinance prohibits the City of North Olmsted from <br />contracting with other government entities to provide diversion services for juveniles charged <br />with a violation of state statutes or local ordinances, subject to the approval of City Council. <br />SECTION 5: If any provision of this Ordinance is found by a court of competent <br />jurisdiction to be invalid, such finding shall not affect the validity of other provisions of this <br />Ordinance that can be given effect without the invalid provision. <br />SECTION 6: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason it is necessary that this legislation go into effect immediately in order that the City <br />may immediately administer a local program that provides education to enhance juvenile <br />awareness of the importance of compliance with traffic and criminal codes generally and within <br />the City of North Olmsted specifically, thereby avoiding further infractions and enhancing the <br />health, safety and welfare of the residents and the motoring public of the City of North Olmsted; <br />and further, provided it receives the affirmative vote of two-thirds of all members of the Council, <br />it shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: )�� ���� i Y, <br />A TTEST: <br />CHARLES MASSAROLO II <br />Clerk of Council <br />3 <br />First Reading: <br />Second Reading: S-15 d <br />Third Reading: Siq9b <br />Committee: <br />NICOLE DAILEYJ E <br />President of Councr <br />
