CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2020 - 23 <br />By: Mayor Kennedy <br />A RESOLUTION DECLARING THE NECESSITY OF THE <br />CONSTRUCTION AND REPAIR OF CERTAIN SIDEWALKS IN THE CITY <br />OF NORTH OLMSTED BY THE ABUTTING PROPERTY OWNERS, THE <br />CONSTRUCTION, REPAIR, AND ASSESSMENT OF THE COSTS OF <br />SIDEWALKS IN CERTAIN CASES BY THE CITY, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the North Olmsted City Council, having established and implemented, in <br />phases, desires to continue its sidewalk repair program in the City of North Olmsted; and <br />WHEREAS, the Ohio Revised Code (Chapter 729) authorizes the City to require private <br />property Owners to construct and repair sidewalks abutting their property; and, <br />WHEREAS, if the abutting property Owner chooses not to perform the necessary <br />construction and repairs, the City may proceed to make the necessary repairs and assess <br />construction and repair costs on the property Owners upon the tax duplicate such. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OFNORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1. That Council approves the plans, specifications, and estimate of <br />cost for the proposed construction and repair of the sidewalks as are on file in the Office <br />of the Clerk of Council located at 5200 Dover Center Road, North Olmsted, Ohio <br />44070. <br />SECTION 2. That the list of lots and lands abutting upon the sidewalks to be <br />constructed or repaired are described by street address and further identified on Exhibit A <br />which is attached hereto and made a part hereof. <br />SECTION 3. That the owners of said described lots and lands abutting such <br />sidewalks shall construct and repair the sidewalks in accordance with the <br />specifications on file in the Office of the Clerk of Council. <br />SECTION 4. That the owners of the said described lots and lands shall construct <br />and repair the sidewalks abutting their lots and lands on or before June 15, 2020. <br />SECTION 5. That in the event such sidewalks are not constructed and repaired <br />by the owners of the lots and lands abutting thereon in accordance with such plans and <br />
