Mixed Use District <br />Section 1149.01 Purpose <br />A. The City contains certain large parcels of land which have not been developed to their full <br />economic potential. The development of these parcels for single family or multiple family use <br />is deemed impractical, while their classification for retail business or limited industry use <br />would not be in keeping with the best interests of the City. In order to preserve and promote <br />the best interests of these parcels as well as their orderly development, they should be <br />placed in a separate zoning category which would permit thereon combinations of garden <br />type developments such as apartments and other multiple family dwellings, commercial <br />buildings, offices, professional and research buildings. <br />In addition, there exists areas within the City, in particular the City's west end, which are not <br />presently zoned for uses which are conducive to the City's goals of orderly and <br />comprehensive development, protection of real estate values, and promotion of land uses <br />presently underserved. These areas likewise should be placed in a separate mixed use <br />zoning category to achieve the above -stated City goals, which will not interfere with the <br />rights of the affected property owners to a fair return on their investments. <br />B. The purpose of this use classification is to designate, regulate and restrict the location, <br />design and use of buildings, structures and interior streets; to promote high standards of <br />exterior appearance of buildings and grounds; to stabilize and improve property value with <br />the smallest possible burden on municipal services and facilities with the highest possible <br />return to the City from tax revenues consistent with maintaining and improving the general <br />character of the City; to promote health, safety, comfort, convenience and general welfare; <br />and thus to provide the economic and social advantages resulting from an orderly planned <br />use of these large parcels of land or targeted City areas. <br />(Ord. 90-125. Passed 5-21-91.) <br />Section 1149.02 Minimum Required Area <br />The minimum required development area for Mixed Use District A and Mixed Use District B <br />shall not be less than ten (10) acres. The minimum required development area for Mixed Use <br />District C shall not be less than 35 acres. In Mixed Use District D, the minimum required <br />development area shall be not less than 20 acres. <br />(Ord. 2002-118. Passed 10-1-02.) <br />Section 1149.03 Uses Permitted <br />A. Mixed Use District A. Any of the uses defined in subsections (13)(1), (2) and (3) hereof shall <br />be permitted. Additionally, uses permitted in a General Retail Business District, as set forth <br />in Section 1139.01, shall be permitted provided, however, that the plan of the development <br />area meets all of the requirements and restrictions set forth in this section and Sections <br />1149.04 to 1149.07 and further provided that the proposed use is approved by the Planning <br />and Design Commission, which shall determine whether it has been integrated into the plan <br />in such a manner as shall promote the intent and purposes of a mixed use development. <br />B. Mixed Use District B. Any of the uses defined in subsections (13)(1), (2) and (3) hereof shall <br />be permitted. Additionally, the following business uses shall be permitted provided, however, <br />that the plan of the development area meets all of the requirements and restrictions set forth <br />in this section and Sections 1149.04 to 1149.07 and further provided that the proposed use <br />is approved by the Commission, which shall determine whether it has been integrated into <br />Page 1149-1 City of North Olmsted Zoning Code <br />
