CITY OF NORTH OLMSTED ORDINANCE NO. 2020 - 45 BY: Mayor Kennedy AN ORDINANCE TO LEVY SIDEWALK ASSESSMENTS UPON LISTED REAL PROPERTY FOR THE TOTAL COSTS INCURRED BY THE CITY OF NORTH OLMSTED TO REPAIR, REPLACE OR CONSTRUCT SIDEWALKS ADJACENT THERETO, AS SUCH IMPROVEMENTS WERE DEEMED NECESSARY AND INSTALLED PURSUANT TO THE 2019 SIDEWALK PROGRAM IN THE CITY OF NORTH OLMSTED, AS AMENDED. WHEREAS, the Ohio Revised Code (Chapter 729.01) and the North Olmsted Charter authorize the City to require Property Owners to construct and repair or replace sidewalks abutting their property; and WHEREAS, pursuant to R. C. 729.02, in 2019 this Council determined the necessity to establish a Sidewalk Program for the City of North Olmsted (Resolution 2019-16 adopted February 19, 2019 and Resolution 2019-54, adopted April 2, 2019); and WHEREAS, the City of North Olmsted notified Property Owners, in accordance with law under R. C. 729.03, allowing for the performance of construction work deemed necessary by the 2019 Sidewalk Program, subject to such sidewalk improvements being subsequently performed by the City's contractors; and WHEREAS, this Council determined to solicit bids from qualified contractors to perform the necessary repair, replacement and reconstruction work, as required by the 2019 Sidewalk Program (Resolution 2019-52, adopted April 16, 2019); and WHEREAS, the City of North Olmsted has entered into contracts and incurred costs to perform the necessary sidewalk improvements for the 2019 Sidewalk Program, which costs are the subject of reimbursement by or assessment of Property Owners; and WHEREAS, pursuant to R.C. 729.08, the City of North Olmsted issued publication of estimated assessments to Property Owners, inviting an opportunity to file written objections to estimated assessments or to reimburse the City for improvement costs incurred; and WHEREAS, pursuant to R.C. 729.04, the City of North Olmsted shall hereby levy assessment of the total costs of sidewalk improvements upon the Property Owners of such real property for the total costs incurred by the City to repair, replace or install sidewalks abutting their property; and WHEREAS, the list of Sidewalk Assessment Balances from the 2019 Sidewalk Program, which includes the total costs of such sidewalk construction, repair or installation adjacent to each lot or land so improved, is and remains on file in the office of the Clerk of Council, and is attached as Exhibit A; and
