CITY OF NORTH OLMSTED RESOLUTION NO. 2020 - 57 BY: Mayor Kennedy A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION TO UPGRADE GUARDRAILS ON STEARNS ROAD IN THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, The State of Ohio, though the Ohio Department of Transportation (ODOT), has identified the need for a roadway project and seeks the cooperation, consent and agreement of the City of North Olmsted, referred to by ODOT as the Local Public Agency (LPA), in order to perform the Project described as follows: Upgrade guardrail end treatments on Stearns Road (CR -76) in the City of North Olmsted. This work is part of a larger ODOT project to upgrade guardrail end treatments on National Highway System routes within Cuyahoga and Lake Counties. WHEREAS, the ODOT agreement assures that the entire cost and expense of the construction will be provided by ODOT; No financial participation will be required by the LPA. Except, however, that LPA agrees to pay 100% of the costs of those features requested by the LPA which are determined by ODOT and Federal Highway Administration to be unnecessary for the Project; and WHEREAS, the City as LPA must agree to acquire and/or make available to ODOT all necessary right-of-way required for the Project, including eligible utility costs, including any relocations; and WHEREAS, the City as LPA must also agree to provide financial provisions for adequate maintenance of the Project, upon completion, and to keep the right-of-way open, free of obstructions, for highway purposes; and WHEREAS, it is the desire of this Council to authorize the Mayor to sign, on behalf of the City of North Olmsted, as LPA, agreement forms or other certificates required by ODOT to enable the Project to proceed for the health, safety, and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That the City of North Olmsted, as LPA, enter into an agreement with the State of Ohio, via ODOT standardized forms, and that the Mayor be and is hereby authorized to execute said agreement, providing for the described guardrail project at Stearns Road, subject to the conditions outlined by ODOT.
