CITY OF NOR'T'H OLMSTED RESOLUTION NO. 2020 - 59 Bv: Mayor Kennedy A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MUTUAL AID AGREEMENT WITH OHIO WARN, A STATEWIDE RA TER17,VASTEWA TER AGENCY RESPONSE, NETWORK (WARN). WHEREAS, certain Ohio water and wastewater agencies (the "AIcrilbers-) have formed the "Ohio Water/Wastewater Agency Response Network." (Ohio WARN).. to share resources and to assist each other in the form of personnel, equipment, materials and supplies in the event of emergencies that disrupt utility services; and WHEREAS, the mission of Ohio WARN is to prepare for natural or human -caused emergencies that may arise in the future and impact the provision of critical utility services, to assist Members with the organization of emergency, response in accordance with established requirements, and to advance the mission of -'utilities helping utilities`' among statewide Members. and WHEREAS, the Members have agreed to enter into this '`Ohio Water/Wastewater Agency Response Network Mutual Aid Aureement." (`'Agreement`"). a copy of which is attached as Exhibit A to describe the teens and conditions under which emergency assistance may be requested and provided; and WHEREAS, it is the desire and intention of this Council to join Ohio WARN and authorize the Mayor to execute this Agreement, on behalf of the City of North Olmsted, in order to participate in this program for Mutual Aid and Assistance within the State of Ohio. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUY9HOGA, AND STATE OF OHIO: SECTION l: That the Mayor be and he hereby is authorized, on behalf of the City of North Olmsted, in accordance with Ohio Revised Code Sections 5502.29 and 5502.41 enabling mutual aid agreements, to enter into this '`Ohio Water/Wastewater Agency Response Network Mutual Aid Agreement." ("Agreement'). a copy of which is attached as Exhibit A, thereby accepting membership in the "Ohio Water'%\'aste\%ater Atoency Responsc Nemork." (Olrio WARN), and to engage in mutual aid with other Ohio WARN members with respect to public utility emergency response. The Agreement shall be in form and substance substantially similar to the attached Agreement, with such changes to be hereinafter made in said contract as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. SECTION 2: That this Resolution shall take effect and be in force fi-om and after the earliest date provided for by law.
