CITY OF NORTH OLMSTED ORDINANCE NO. 2020 - 84 BY: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION TO ALLOW THE RESURFACING OF BROOKPARK ROAD (SR -17) FROM LORAIN ROAD (SR -10) TO THE EAST CORPORATION LIMIT (ECL) IN THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, The State of Ohio, though the Ohio Department of Transportation (ODOT), has identified the need for a roadway project and seeks the cooperation, consent and agreement of the City of North Olmsted, referred to by ODOT as the Local Public Agency (LPA), in order to perform the Project described as follows: Resurface SR -17 from Lorain Road (SR -10) to the east corporation limit (ECL) in the City of North Olmsted. WHEREAS, the ODOT agreement requires the City, as the Local Public Agency (LPA) to participate in the costs of the project, specifically the entire cost and expense of the improvement, less the amount of Federal -aid funds set aside by ODOT. Such costs to the City shall include any features determined to be unnecessary by ODOT and include cost to install and/or repair curb ramps; and WHEREAS, it is the desire of this Council to authorize the Mayor to sign, on behalf of the City of North Olmsted, as LPA, agreement forms or other certificates required by ODOT to enable the Project to proceed for the health, safety, and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the City of North Olmsted, as LPA, enter into an agreement with the State of Ohio, via ODOT standardized forms, and that the Mayor be and is hereby authorized to execute said agreement, providing for the described Brookpark Road resurfacing project, subject to the conditions outlined by ODOT. SECTION 2: That the City, as LPA, hereby authorizes and requests the Director of Transportation to proceed with the aforesaid highway improvement project. SECTION 3: That the City, as LPA, transmit to the Director of Transportation a fully executed copy of this Resolution and otherwise certify its legislative approval on forms to the satisfaction of ODOT.
