Exhibit B: Chapter 1163 Signs (Proposed) <br />(g) Written consent of the owner of the building, structure or land to which or on which <br />the sign or advertising structure is to be erected; and <br />(h) Any information, calculations or documentation required by the Ohio Building Code <br />or the Codified Ordinances of the City of North Olmsted. <br />Every applicant, upon applying for a permit pursuant to this section shall pay to the City <br />the nonrefundable fee established by separate ordinance. <br />B. Permit Review and Issuance <br />1. Upon receipt of a complete and accurate application for a sign permit, the Planning <br />Director and/or Building Commissioner shall examine the plans and specifications, and, <br />within 30 days, determine if the signs proposed in the application are in compliance with <br />this chapter. <br />2. In the event of a variance request, or other delay caused by the applicant, the time for <br />making a determination of sign compliance under this section shall be extended for a <br />period of time equal to the time period during which the variance application is pending, <br />or to the period of time of other delay caused by the applicant, whichever is applicable. <br />3. If the proposed sign complies with this chapter, all other applicable laws and ordinances <br />of the City and the Ohio Building Code, if applicable, the Building Commissioner shall <br />forthwith issue the requested permit upon receipt of the appropriate fees. Plan approval <br />and subsequent granting of a permit for any sign subject to the Ohio Building Code is <br />governed by the requirements and time restrictions of the Ohio Building Code. If the <br />Building Commissioner determines that the application should be denied, he shall issue <br />a written statement with his decision, explaining the reason(s) for the denial. <br />4. If the work authorized under any sign permit is not completed within six months after the <br />date of issuance, the permit shall become null and void. <br />C. Violation and Revocation of Sign Permit <br />The Building Commissioner may revoke a sign permit where there has been a violation of <br />the provisions of this chapter or a misrepresentation of fact on the permit application. The <br />Building Commissioner shall issue a written statement with their decision, explaining the <br />reasons for revocation. <br />D. Appeals <br />1. If the applicant is dissatisfied with any determination of the Planning Director or Building <br />Commissioner made during the application process related to the requirements of this <br />chapter or zoning review, including but not limited to requirement of additional materials, <br />the classification of a proposed sign, the denial of a permit or the revocation of a permit, <br />the applicant may, within 10 business days following that determination, file an appeal by <br />making application to the Building and Zoning Board of Appeals. <br />2. The Building and Zoning Board of Appeals shall hear the applicant's appeal at a meeting <br />which shall be scheduled and held no later than 30 days following the date of the filing of <br />the application. The Building and Zoning Board of Appeals may decide to affirm, modify, <br />reverse or vacate the Planning Director or Building Commissioner's decision, and shall <br />render its decision and any order necessary to effectuate its decision within five days <br />following its hearing of the applicant's appeal. <br />3. The decision of the Building and Zoning Board of Appeals shall be final and may only be <br />reviewed by a Court of Common Pleas, pursuant to the provisions of Chapter 2506 of <br />Page 1163-5 City of North Olmsted Zoning Code <br />
