CITY OF NORTH OLMSTED RESOLUTION NO. 2020 - 118 BY: Mayor Kennedy A RESOLUTION AUTHORIZING THE MAYOR TO RENEW THE CONTRACT BETWEEN THE CITY AND KARRIE SKALL TIPTON / NORTH OLMSTED GYMNASTICS, INC FOR THE PROVISION OF PROFESSIONAL GYMNASTICS INSTRUCTION SERVICES AT THE NORTH OLMSTED RECREATION CENTER FOR AN ADDITIONAL SIX MONTH TERM WITH OPTION TO EXTEND FOR FULL ONE (1) YEAR, AS AMENDED. WHEREAS, Karrie Skall Tipton has, pursuant to a series of contracts authorized by this Council, provided gymnastics program services at the City's Recreation Center since 1999; and WHEREAS, it is the recommendation of the Mayor that the current contract between the City and Ms. Tipton / North Olmsted Gymnastics, Inc. be renewed for an additional six (6) month term, for the retroactive period October 1, 2020 through March 31, 2021; and WHEREAS, it is the desire of this Council to dispense with initiating an RFP or RFQ process for said services and to approve and authorize the renewal contract with Ms. Tipton / North Olmsted Gymnastics, Inc. in substantially the form as attached hereto, to provide for the contract to be effective as of October 1, 2020, and to authorize the Mayor to execute said contract. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to execute a renewal contract with Karrie Skall Tipton / North Olmsted Gymnastics, Inc. in substantially the form and substance as evidenced in the Agreement for Gymnastic Instruction Services, attached to this Ordinance as "Exhibit A," with only such changes to said contract to be hereinafter made as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law. Said contract shall be for a six (6) month term retroactively effective October 1, 2020 and, concluding March 31, 2021, unless an option to extend is exercised by Contractor. SECTION 2: That this Resolution shall take effect and be in force from and after the earliest period allowed by law upon its passage and approval by the Mayor.
