CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2020 - 126 <br />By: Mayor Kennedy <br />A RESOLUTION AUTHORIZING THE MAYOR TO PURCHASE A NEW <br />375 KVA GENERATOR FROM OHIO CAT AT A COST OF $61,300.00 FOR <br />THE LEBERN PUMP STATION, THROUGH A STATE PURCHASE <br />PROGRAM, AND FURTHER AUTHORIZING THE MAYOR TO EXECUTE <br />ALL CONTRACT DOCUMENTS FOR PURCHASE OF THE SAME, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, Sourcewell is a service cooperative created by the Minnesota legislature as a <br />local unit of government (Minn. Const. art. XII, sec. 3) that holds hundreds of competitively <br />selected contracts for various goods and services; and <br />WHEREAS, R.C. §9.48 provides that a political subdivision, like the City of North <br />Olmsted, may participate in a joint purchasing program operated by or through a national or state <br />association of political subdivisions and that such purchases are exempt from competitive <br />selection requirements otherwise required by law; and <br />WHEREAS, the Superintendent of the Waste Water Treatment Plant recommends that <br />the City acquire one (1) new replacement 375 KVA generator with sound -attenuated enclosure <br />for use at the Lebern lift station, priced through the Sourcewell program, as available at Ohio <br />CAT for a price of $61,300.00; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to purchase said <br />generator through the Purchase Program and to further authorize the Mayor to execute any <br />contract documents required for such expenditure, including a contract with Ohio CAT. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to purchase through the <br />Purchase Program in accordance with R.C. Section 125.01, et seg. and, additionally, Section <br />9.48, and which the City is authorized to participate in pursuant to the City Charter and <br />Resolution No. 87-6 and Section 9.48, one (1) new 375 KVA generator with sound -attenuated <br />enclosure, at a cost of $61,300.00 from Ohio CAT, all of which is described in the specifications <br />on file in the Service Department and on Exhibit A. The Mayor is hereby authorized to execute <br />any contract documents with vendors and, as necessary, to effectuate the State Purchase Program. <br />Any contract executed by the Mayor shall be in a form and substance consistent with the <br />provisions of this Resolution and be approved by the Director of Law. <br />SECTION 2: That this Resolution shall take effect and be in fefee ftem and after- the <br />eafliest pefied allowed by i .,.
