Signature ofthe employee. <br />16.03 The follov,y in,, steps shall be follo� ns11 -ved in the processiof a grievance. <br />Step 1. Within seven (7) working days of the incident or knowled�ae of the incident the <br />aggrieved employee shall submit his written grievance to the Shift Lieutenant, or his desiumcc. <br />who shall indicate the date and time of receipt ofthe grievance, and affix his signature to the <br />­rievance form. That Shift Lieutenant shall respond in writing to the grievant within five (5) <br />working days of receipt of the grievance. <br />Step ` , A grievance Unresolved at Step 1 may he submitted by the grievant to the Chief of <br />Police, or his designee, within five (5) working days from receipt of the Step 1 answer. It shall be <br />the responsibility, of the Chief of Police, or his designee. to investigate the matter, hold such <br />hearings as necessary, and to provide a written response to the grievant within the ten ( l0) <br />workino days of receipt of the grievance. The grievant may, at his option, be represented by a <br />representative of the FOP at any hearing or hearings held at this level. <br />Step 3. A grievance unresolved at Step I may be submitted by thegrievant to the Safety <br />Director, or his designee, within five (5) \,orkim) days of receipt of the Step ? answer. The <br />Safety Director, or his designee, mai meet with the grievant and a representative of the FOP if <br />the employee desires, within seven (7) calendar days of submission of the grievance to Step 3.. to <br />discuss the grievance. The Safety Director, or his designee. shall provide a written response to <br />the grievant within five (3) calendar days of such meeting. Grievances unresolved at Step 3 may <br />be submitted to arbitration upon request of the FOP in accordance with the provisions of Section <br />16.06 of the Article. <br />16.06 The FOP, based upon the facts presented, has the right to decide whether to arbitrate a <br />grievance. Within thirty (30) calendar days from the date of the final answer on a grievance from <br />Step 3. the FOP shall notify the Fmployer, via email writh receipt, of its intent to seek arbitration <br />of an unresolved grievance. <br />When a timely request for arbitration is submitted, the Union and the Employer or his <br />designee shall attempt to select an arbitrator by mutual agreement. If the parties are unable to <br />agree upon an arbitrator, then the Federal Mediation & Conciliation Service (FMCS) shall be <br />requested to submit a panel of seven (7) qualified arbitrators. the parties may attempt to limit <br />their choice to the FMCS sub -region for Northern Ohio. The Union shall be responsible for the <br />initial cost of the panel. If an arbitrator's panel is not requested by the Union within thirty (30) <br />days of the Employer's final response to the grievance at Step 3, the arbitration request will be <br />deemed dropped and the Step 3 answer will be considered final. Fach party has the right to <br />request a second panel, one time each, for each grievance advanced to this step. The requesting <br />party will be responsible for the full cost of such panel. Failing to mutually agree upon an <br />arbitrator from the panel, the parties shall strike names alternately.. with the Union's 1 -k -it to <br />strike the first name. All decisions reached by the arbitrator shall be final and binding on both <br />parties with the fee and expenses charged by the arbitrator to be borne equally by the losing <br />party, as determined by the arbitrator. Fach party shall pay the cost of its own representatives <br />and witnesses, unless the employee is already on duty; then they shall not suffer loss of pay. <br />13 <br />
