Such employee may he subject to periodic retesting at the Fâ–ºnployer's discretion, upon return to <br />his position for a period of two (2) years from the date of his return. <br />30.08 Any employee in the above mentioned rehabilitation program will not lose any seniority <br />should it be necessary that he be required to take an unpaid medical leave of absence. <br />AR"1,10 T, 31 FATAL L ORCF <br />31.01 Anv time a bargaining unit member participated in administering fatal force.. the <br />following provisions shall apply: <br />A. The employee may receive up to five (5) days off. but steal l not receive less than three <br />(3) working days off. <br />1. An extension of time shall be granted by the Chief of Policc if he deems <br />necessary. <br />L?. The employee shall continue to receive his or her City benefits for this five (5) or <br />three (3) day period, or an approved extension thereof. <br />C. Time off from the duties of the employee for fatal force shall not be deducted from <br />any benefit ofthis Agreement. <br />D. Should the employee require medical treatment for any mental disorder arising from <br />his or her actions in the use of fatal force, the City shall provide the cost for the <br />necessary treatment beyond the present hospitalization bcwnefit provided that the <br />employee submits: <br />1. Verification of treatment needed. <br />2. Treatment does not exceed $1,500.00. and <br />3. Permission to exceed this cost limit must be approved, in writing, by the Manor. <br />Should a suspension/leave of the employee pending investigation of the fatal force be <br />implemented, the employee shall continue to receive full pay and benefits during such <br />suspension/paid leave. <br />ARTI CLF 32 G NDL;R AND PLURAL, <br />32.01 Whenever the context so requires, the use of words herein, in the singular, shall be <br />construed to include the plural, and words in the plural. the singular, and words whether in the <br />masculine, feminine or neuter gender shall be construed to include all of said genders. By the <br />use of either the masculine or feminine genders it is understood that said use is for convenience <br />purposes only and is not to be interpreted to be discriminatory by reason of sex. <br />,; <br />
