CITY OF NORTH OLMSTED RESOLUTION NO. 2020 - 159 By: Councilmember Hemann A RESOLUTION EXTENDING TEMPORARY OUTDOOR PATIO DINING AREAS, AND DECLARING AN EMERGENCY. WHEREAS, given the ongoing COVID-19 crisis, its hardship upon the local restaurant industry, this Council adopted Resolution 2020-56 to enable and encourage City of North Olmsted dining establishments to have and offer temporary outdoor dining areas; and WHEREAS, in conjunction with said Resolution 2020-56, the administration published guidelines for temporary outdoor dining areas, which streamlined authorization procedures for North Olmsted restaurants, while also ensuring the safety of patrons; and WHEREAS, in order to continue the program into 2021, an extention of Resolution 2020-56 is necessary because it is scheduled to expire on December 31, 2020; and WHEREAS, it is the desire of this Council to exend the program permitting temporary authorization of outdoor patio dining areas. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the provisions of Resolution 2020-56, including the Outdoor Patio Dining Areas criteria adopted therein and which are incorporated by reference, are hereby readopted as a policy in the City of North Olmsted and extended through May 31, 2021. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and for the further reason that it will immediately extend Resolution 2020-56 before it expires on December 31, 2020; and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
