MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />DECEMBER 15, 2020 <br />Present: Council President Jones, Council Members Brossard, Glassburn, Hemann, <br />Kelly, Limpert & Schumann <br />Also Present: Mayor Kennedy, Director of Finance Copfer, Director of Human <br />Resources Gallo, Director of Law Gareau, Director of Planning & <br />Community Development Lieber and Clerk of Council Massarolo <br />Absent: Council Member Williamson <br />Council President Jones called the meeting to order at 8:18 p.m. through GoToMeeting. <br />Due to the meeting being a virtual meeting, Council President Jones requested if any <br />member of the public using a computer wished to address Council to notify the Clerk via <br />the chat feature in GoToMeeting and they would be called on later in the meeting. For <br />those dialing in via phone, the lines would be unmuted during the appropriate portion of <br />the meeting. <br />The following legislation will be considered for passage under suspension of the rules <br />this evening: Second Reading: Resolution 2020-127, Resolution 2020-143 and <br />Resolution 2020-144; First Reading: Ordinance 2020-149. <br />REPORTS <br />Mayor Kennedy: <br />• No Report. <br />Director of Law Gareau: <br />• Council had a very good budget discussion. It was handled very well with a lot of <br />good input and meaningful discussion. <br />• New litigation has been commenced against the City. It's Kelly Patrick v. City of <br />North Olmsted. Kelly Patrick has filed in the Ohio Court of Claims and is alleging <br />a violation of public records law. The City denies that is the case. The court <br />immediately refers these cases to mediation. <br />• There is a strange case that was here, it went away, it came back and now it looks <br />like it is going away again. It's a mandamus action that has been mentioned at a <br />couple of meetings already. It's an attempt to force the prosecutor and the <br />Cuyahoga County prosecutor to bring charges on a case a decade old. It was <br />dismissed once and the Court of Appeals last week took another look at it. The <br />City filed a motion to dismiss which was granted. There was a motion to <br />reconsider, which was denied. So this case should be done unless it is appealed to <br />the Ohio Supreme Court. <br />• During the Budget Process it was stated most of our claims for personal injury are <br />handled by insurance defense. A specific issue at the Recreation Center where <br />someone was injured was brought up. In that case, counsel has been retained and <br />
