CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2021 — 2 <br />BY: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF HUMAN <br />RESOURCES TO REQUEST PROPOSALS FROM QUALIFIED <br />INDIVIDUALS TO PROVIDE NUISANCE ABATEMENT SERVICES FOR <br />2021; AND FURTHER AUTHORIZING THE MAYOR, SUBJECT TO <br />APPROVAL OF THE BOARD OF CONTROL, TO ENTER INTO AN <br />AGREEMENT WITH THE INDIVIDUAL SELECTED IN THE RFP <br />PROCESS, AND DECLARING AN EMERGENCY. <br />WHEREAS, in the enforcement of the Exterior Property Maintenance Code by the <br />Division of Building, the City utilizes third party vendors to cut grass and perform landscape <br />services on properties deemed to have a nuisance condition present; and <br />WHEREAS, the City is in need of a vendor to perform such services for the year 2021; <br />and <br />WHEREAS, upon the recommendation of the Director of Human Resources, it is the <br />desire of this Council to authorize the Director to request proposals from qualified individuals to <br />provide landscape services in connection with enforcement of the Exterior Property Maintenance <br />Code and further to authorize the Mayor to enter into an agreement with the individual selected <br />in the RFP process following approval by the Board of Control. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Human Resources be and she hereby is authorized to <br />request proposals from qualified individuals to provide landscape services in 2021. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board <br />of Control, to enter into an agreement with the person or company selected in the RFP process <br />for a term of one (1) year. Said agreement shall further be in a form and substance that is not <br />substantially adverse to the City and which is approved by the Director of Law. The character of <br />any such changes as not being substantially adverse to the City shall be evidenced conclusively <br />by the execution of the agreement by the Mayor and the approval of the agreement by the <br />Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary to have a landscape service provider in place at the start of the <br />spring growing season, when seasonal enforcement of landscape violations occurs, and further <br />
