CITY OF NORTH OLMSTED ORDINANCE NO. 2020-77 BY: Councilman Schumann AN ORDINANCE AMENDING SECTION 1135.02 OF THE ZONING CODE OF THE CITY OF NORTH OLMSTED ENTITLED "ACCESSORY USES" FOR THE PURPOSE OF ELIMINATING THE TWO HUNDRED FOOT RESIDENTIAL LOT SETBACK REQUIREMENT FOR ANIMAL SHELTERS USED FOR CHICKEN, AS AMENDED. WHEREAS, the Zoning Code Section 1135.02(e) requires that animal shelters be located not less than two hundred feet (200') from nearby residential lots; and WHEREAS, this restriction is found to be so restrictive, as applied to standard sized residential lots, as to prohibit chicken coops and similar accessory structures; and //fL, WHEREAS, the Planning and Design mi ion on the Cday of �V�✓� 2020, by formal motion, (reeommen - did not recommend) that this Ordinance, proposing to amend the Zoning Co21-e-of'the City of North Olmsted as set forth herein, be adopted; and WHEREAS, following publication of newspaper notice, a public hearing was held, in conformance with the provisions ons of Sectio 14 oArticle IV of the Charter and Section 1127.03 of the Zoning Code, on the � day of 2020. WHEREAS, it is the desire of this Council to amend Section 1135.02 of the Zoning Code of the City of North Olmsted, as indicated herein, to remove the 200' restriction on the location of animal shelters used for chickens. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 1135.02, "Accessory Uses," which currently reads as set forth on Exhibit A, which is incorporated herein as though fully rewritten, shall be amended and as amended, shall read in its entirety as set forth on attached Exhibit A, with amendments noted by bold face text in 1135.02(e)(1) and as further amendments are displayed in red lettering. SECTION 2: That this Ordinance shall take effect and be in force from and after the earliest date provided for by law.
