CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2020-77 <br />BY: Councilman Schumann <br />AN ORDINANCE AMENDING SECTION 1135.02 OF THE ZONING CODE <br />OF THE CITY OF NORTH OLMSTED ENTITLED "ACCESSORY USES" <br />FOR THE PURPOSE OF ELIMINATING THE TWO HUNDRED FOOT <br />RESIDENTIAL LOT SETBACK REQUIREMENT FOR ANIMAL <br />SHELTERS USED FOR CHICKEN, AS AMENDED. <br />WHEREAS, the Zoning Code Section 1135.02(e) requires that animal shelters be located <br />not less than two hundred feet (200') from nearby residential lots; and <br />WHEREAS, this restriction is found to be so restrictive, as applied to standard sized <br />residential lots, as to prohibit chicken coops and similar accessory structures; and <br />//fL, <br />WHEREAS, the Planning and Design mi ion on the Cday of <br />�V�✓� 2020, by formal motion, (reeommen - did not recommend) that this <br />Ordinance, proposing to amend the Zoning Co21-e-of'the City of North Olmsted as set forth <br />herein, be adopted; and <br />WHEREAS, following publication of newspaper notice, a public hearing was held, in <br />conformance with the provisions ons of Sectio 14 oArticle IV of the Charter and Section 1127.03 <br />of the Zoning Code, on the � day of 2020. <br />WHEREAS, it is the desire of this Council to amend Section 1135.02 of the Zoning Code <br />of the City of North Olmsted, as indicated herein, to remove the 200' restriction on the location <br />of animal shelters used for chickens. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1135.02, "Accessory Uses," which currently reads as set <br />forth on Exhibit A, which is incorporated herein as though fully rewritten, shall be amended and <br />as amended, shall read in its entirety as set forth on attached Exhibit A, with amendments noted <br />by bold face text in 1135.02(e)(1) and as further amendments are displayed in red lettering. <br />SECTION 2: That this Ordinance shall take effect and be in force from and after the <br />earliest date provided for by law. <br />
