3(-51 CITY OF NORTH OLMSTED ORDINANCE NO. 2020 - 125 BY: Mayor Kennedy AN ORDINANCE AUTHORIZING A TEMPORARY VACANCY IN THE POSITION OF DIRECTOR OF PUBLIC SAFETY. WHEREAS, on May 4, 2010, the electors of the City of North Olmsted approved Issue 34 to amend the Charter of the City of North Olmsted, whereby all departments and divisions there under, with the exception of the Department of Law and the Department of Finance, are to be established by the Council via ordinance; and WHEREAS, via Ord. 2010-66, this Council created a revised Chapter 139, Department of Public Safety, an reestablished the Department of Safety and created the position of Director of Public Safety; and WHEREAS, the Department of Public Safety and the Department of Public Service are two, distinct Departments within the City that may, in the discretion of the Mayor by and through the nomination and approval process, be headed by the same individual; and WHEREAS, the position of Director of Public Safety was vacated on or about August 31, 2020; and WHEREAS, the only two (2) divisions within the Department of Public Safety (Divisions of Police and Fire) are headed by a professional Chief of Police and Chief of Fire and have been operating efficiently despite the absence of a Director of Public Safety; and WHEREAS, the Mayor respectfully requests Council's authorization to leave the position vacant until further ordinance, a later nomination, or the end of the current term, December 31, 2021. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the position of Director of Public Safety, as established by this Council in Ord. 2010-66 and codified in Chapter 139, may remain vacant and the Mayor need not present a nomination to fill the vacancy, as specifically requested by the Mayor, until the earlier of (1) an ordinance repealing this ordinance; (2) a nomination by the Mayor to fill the vacancy of Director of Public Safety; or (3) December 31, 2021. SECTION 2: That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
