3(-51 <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2020 - 125 <br />BY: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING A TEMPORARY VACANCY IN THE <br />POSITION OF DIRECTOR OF PUBLIC SAFETY. <br />WHEREAS, on May 4, 2010, the electors of the City of North Olmsted approved Issue <br />34 to amend the Charter of the City of North Olmsted, whereby all departments and divisions <br />there under, with the exception of the Department of Law and the Department of Finance, are to <br />be established by the Council via ordinance; and <br />WHEREAS, via Ord. 2010-66, this Council created a revised Chapter 139, Department <br />of Public Safety, an reestablished the Department of Safety and created the position of Director <br />of Public Safety; and <br />WHEREAS, the Department of Public Safety and the Department of Public Service are <br />two, distinct Departments within the City that may, in the discretion of the Mayor by and through <br />the nomination and approval process, be headed by the same individual; and <br />WHEREAS, the position of Director of Public Safety was vacated on or about August 31, <br />2020; and <br />WHEREAS, the only two (2) divisions within the Department of Public Safety <br />(Divisions of Police and Fire) are headed by a professional Chief of Police and Chief of Fire and <br />have been operating efficiently despite the absence of a Director of Public Safety; and <br />WHEREAS, the Mayor respectfully requests Council's authorization to leave the <br />position vacant until further ordinance, a later nomination, or the end of the current term, <br />December 31, 2021. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the position of Director of Public Safety, as established by this <br />Council in Ord. 2010-66 and codified in Chapter 139, may remain vacant and the Mayor need <br />not present a nomination to fill the vacancy, as specifically requested by the Mayor, until the <br />earlier of (1) an ordinance repealing this ordinance; (2) a nomination by the Mayor to fill the <br />vacancy of Director of Public Safety; or (3) December 31, 2021. <br />SECTION 2: That this Ordinance shall take effect and be in force from and after the <br />earliest period allowed by law. <br />
