CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2019 - 47 <br />BY: Councilperson Glassburn <br />AN ORDINANCE AMENDING AND RESTATING CHAPTER 950 OF <br />THE CODIFIED ORDINANCES OF THE CITY OF NORTH <br />OLMSTED ENTITLED "URBAN FOREST, " AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, The City's Urban Forest Chapter 950, administered by the City <br />Forester, under the Director of Public Service, includes a number of processes the review <br />and approval of tree removal permits under North Olmsted Codified Ordinance <br />("N.O.C.O") §950; and <br />WHEREAS, as a matter of housekeeping, N.O.C.O. §950.03(e) (1) contains an <br />erroneous reference to the Architectural Review Board and N.O.C.O. § 1126.04(d), which <br />public body and subsection no longer exist; and <br />WHEREAS, because Residential Cluster Districts are, by nature, residential in <br />character as opposed to commercial, it is accordingly the desire of this Council to <br />distinguish these two by eliminating the requirement to amend landscape plans as a <br />prerequisite to issuance of tree removal permits in Residential Cluster Districts. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 950 of the Streets, Utilities, and Public Services <br />Code, which presently reads as set forth on Exhibit A, be amended and as amended shall <br />read in its entirety as set forth on Exhibit B. <br />SECTION 2: That all ordinances, and parts of ordinances, inconsistent or in <br />conflict with this Ordinance, shall, to the extent of such inconsistency or conflict, be <br />repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the public health, safety and welfare; and further provided it <br />receives the affirmative vote of two thirds of the members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />
