CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2021 - 20 <br />By: Mayor Kennedy <br />A RESOLUTION A UTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH THE CUYAHOGA COUNTY JUVENILE COURT TO <br />PARTICIPATE IN THE COURT'S COMMUNITY DIVERSION PROGRAM <br />TO HEAR STATUS, MISDEMEANOR, OR FELONY OFFENSE <br />COMPLAINTS THAT OCCUR IN THE CITY OF NORTH OLMSTED OR <br />HAVE BEEN COMMITTED ELSEWHERE AND RESULT IN <br />COMPLAINTS AGAINST JUVENILE RESIDENTS OF THE CITY OF <br />NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council desires to enter into an Agreement with the Cuyahoga County <br />Juvenile Court to participate in the Court's Community Diversion Program to hear status, <br />misdemeanor, and felony offense complaints charging juvenile offenders with such offenses that <br />have occurred in the City of North Olmsted, as well as such complaints that charge juvenile <br />offenders that reside in the City of North Olmsted; and <br />WHEREAS, for several years the City of North Olmsted has successfully operated youth <br />and community diversion programs, including those in cooperation with the Court, with the <br />objective to prevent, control and rehabilitate juvenile delinquency; and <br />WHEREAS, the County has recently proposed the attached Agreement, which contains a <br />term from March 1, 2021 to December 31, 2021, and contains a stipend of $7,600.00. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized to enter into an Agreement <br />with the Cuyahoga County Juvenile Court to participate in the Court's Community Diversion <br />Program sponsored by the Court for charged juvenile status, misdemeanor, and felony offenses <br />and to request financial assistance in connection with a Community Diversion Program <br />sponsored by the Cuyahoga County Juvenile Court for the period of March 1, 2021 to December <br />31, 2021. Said contract shall be substantially in the form of the "Community Diversion Program <br />Agreement," marked as Exhibit "A" and attached hereto. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately to ensure the <br />flow of funds from the contract so as to not interrupt services for diversion; and further provided <br />it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor. <br />
