CITY OF NORTH OLMSTED RESOLUTION NO. 2021 - 20 By: Mayor Kennedy A RESOLUTION A UTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE CUYAHOGA COUNTY JUVENILE COURT TO PARTICIPATE IN THE COURT'S COMMUNITY DIVERSION PROGRAM TO HEAR STATUS, MISDEMEANOR, OR FELONY OFFENSE COMPLAINTS THAT OCCUR IN THE CITY OF NORTH OLMSTED OR HAVE BEEN COMMITTED ELSEWHERE AND RESULT IN COMPLAINTS AGAINST JUVENILE RESIDENTS OF THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, this Council desires to enter into an Agreement with the Cuyahoga County Juvenile Court to participate in the Court's Community Diversion Program to hear status, misdemeanor, and felony offense complaints charging juvenile offenders with such offenses that have occurred in the City of North Olmsted, as well as such complaints that charge juvenile offenders that reside in the City of North Olmsted; and WHEREAS, for several years the City of North Olmsted has successfully operated youth and community diversion programs, including those in cooperation with the Court, with the objective to prevent, control and rehabilitate juvenile delinquency; and WHEREAS, the County has recently proposed the attached Agreement, which contains a term from March 1, 2021 to December 31, 2021, and contains a stipend of $7,600.00. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to enter into an Agreement with the Cuyahoga County Juvenile Court to participate in the Court's Community Diversion Program sponsored by the Court for charged juvenile status, misdemeanor, and felony offenses and to request financial assistance in connection with a Community Diversion Program sponsored by the Cuyahoga County Juvenile Court for the period of March 1, 2021 to December 31, 2021. Said contract shall be substantially in the form of the "Community Diversion Program Agreement," marked as Exhibit "A" and attached hereto. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Resolution go into effect immediately to ensure the flow of funds from the contract so as to not interrupt services for diversion; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
