AGREEMENT BETWEEN THE CITY OF NORTH OLMSTED AND THE CITY OF FAIRVIEW PARK FOR PRISONER HOUSING SERVICES The City of Fairview Park ("Fairview Park") and the City of North Olmsted ("North Olmsted") agree to the use of the North Olmsted Police Jail Facility for persons to be incarcerated by the Fairview Park Police Department under the following terms and conditions: 1. The cost of housing each inmate shall be S65.00 per day to be paid directly to North Olmsted as billed on a monthly basis. 2. Fairview Park shall be responsible for all medical care and/or other extraordinary costs or services, including but not limited to meals, that may arise for any inmate housed by North Olmsted on behalf of Fairview Park. 3. Fairview Park shall assume responsibility that all appropriate and necessary legal documents are served on those persons incarcerated by Fairview Park. 4. Fairview Park shall be responsible for the transportation and appearance of all inmates at all court/legal proceedings. North Olmsted will install any equipment or hardware to allow Fairview Park officers to appear via video. Fairview Park will be responsible for all costs related to said equipment. 5. Fairview Park shall supply the North Olmsted Correctional Officers with sufficient information as may be required to insure the completion of all necessary inmate documentation and processing. 6. Fairview Park shall assume responsibility for the timely release of inmates incarcerated by Fairview Park. 7. North Olmsted shall perform all required booking functions and processing as detailed in the North Olmsted Jail Policy Manual. 8. North Olmsted shall insure the proper housing of persons incarcerated by Fairview Park. 9. North Olmsted shall be responsible for the proper feeding of persons incarcerated. Special dietary requirements may come under the extraordinary cost/service provision previously stated in paragraph 2. 10. North Olmsted shall provide and complete (with information provided by Fairview Park) the necessary and appropriate forms for reception, booking and release. 11. North Olmsted shall provide emergency care to include emergency transportation to a hospital or medical facility as determined by the North Olmsted Fire Department and/or the Jail Staff Physician at Fairview Park's cost. 12. The term of this Agreement shall be three (3) years from the date of execution and shall be renewable for an additional one (1) year by agreement of both parties. 13. Either party may cancel this Agreement during the agreement term provided one (1) year notice, in writing, of the intent to cancel is provided to the other party. 14. This Agreement may be amended in writing by agreement of both parties. 15. In the event any part or portion of this Agreement shall be found to be contrary to law and thereby held to be null and void, all other provisions of this Agreement shall remain in full force and effect and shall not be otherwise affected by any such ruling, finding or decision. 16. Both parties shall maintain comprehensive, general liability policies of insurance that address coverage of risks arising from the performance of public safety activities herein and both parties shall obtain a specific Certificates of Additional Insurance naming the other party. Consequently, North Olmsted is required to be listed as an Additional Insured under Fairview Park's insurance policy, and likewise, Fairview Park is required to be listed as an Additional Insured under North Olmsted's insurance policy. Each party is responsible for the submission of this Agreement to its own insurance carrier and for production of the Certificate of Additional Insured as required herein to list and identify
