CITY OF NORTH OLMSTED ORDINANCE NO. 2021 - 21 BY: Council President Dailey Jones AN ORDINANCE CREATING NEW SECTION 109.09 ENTITLED "ELECTRONIC MEETINGS" OF CHAPTER 109 OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED, "PUBLIC MEETINGS" IN ORDER TO ESTABLISH PROCEDURES FOR THE USE OF THE ELECTRONIC MEETING FORMAT FOR PUBLIC MEETINGS OF MUNICIPAL BODIES, AS AMENDED. WHEREAS, with a recommendation from the City of North Olmsted Charter Review Commission, this Council via Ordinance 2020-91 submitted to the electors of the City of North Olmsted a proposed charter amendment to the City of North Olmsted Charter to permit virtual or electronic meetings within the City; and WHEREAS, on November 3, 2020, the electors of the City of North Olmsted approved Issue 22 with 82% of those voting casting an affirmative vote for the use of electronic meetings; and WHEREAS, the electronic meeting, or virtual meeting format for public meetings presents unique issues not present for live, in-person meetings; and WHEREAS, this Council desires to establish procedures for the use of electronic meetings of public bodies in the City of North Olmsted. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That there is established a new Section 109.09 entitled "Electronic Meetings" of Chapter 109 of the codified ordinances of the City of North Olmsted entitled "Public Meetings" which shall read in its entirety as follows: 109.09 Electronic Meetings (1) As used in this section: (a) "Electronic meeting" is a meeting or hearing of a municipal body by teleconference, video conference, a combination of videoconference with audioconference or any other similar electronic technology. (b) "Videoconference" is a meeting of a municipal body conducted among participants where at least two (2) members, inclusive of the meeting host, transmit and receive both audio and video data via computer, smartphone, etc.
