CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2021 - 42 <br />BY: Mayor Kennedy <br />AN ORDINANCE DISPENSING WITH THE REQUIREMENTS OF NORTH <br />OLMSTED CODIFIED ORDINANCE SECTION 111.01, ENTITLED "CITY <br />CONTRACTS INVOLVING THE RECEIPT OF FUNDS" AND <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH <br />CLEVELAND ICE STORM SKATING CLUB TO PROVIDE CONCESSION <br />SERVICES AT THE RECREATION CENTER. <br />WHEREAS, Section 111.01 of the Codified Ordinances of the City of North Olmsted <br />allows the Mayor to permit community groups or charitable groups to staff concession stands in <br />public parks for a fee, but is silent about such activities at the Recreation Center; and <br />WHEREAS, the Cleveland Ice Storm Skating Club has a history with the City of North <br />Olmsted and has offered limited concession services in the past; and <br />WHEREAS, the proposed term is nine (9) months, with the Skating Club paying the City <br />$125.00 a month; and <br />WHEREAS, the Mayor and Commissioner Drenski believe that it is best for the <br />Cleveland Ice Storm Skating Club to provide basic, limited concession services to the patrons of <br />the Recreation Center during mutually agreeable times and dates; and <br />WHEREAS, it is the desire of this Council to dispense with the requirements of Section <br />111.01 of the Codified Ordinances of the City of North Olmsted and to authorize the Mayor to <br />execute a concessions contract with Cleveland Ice Storm Skating Club. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the requirements of North Olmsted Codified Ordinance Section <br />111.01 be and are hereby suspended for this concession contract and the Mayor is authorized to <br />execute a concession contract with Cleveland Ice Storm Skating Club for services in <br />substantially the form and substance as evidenced in the contract attached to this Ordinance as <br />"Exhibit A," with only such changes to said contract to be hereinafter made as are not <br />substantially adverse to the City and which are approved by the Director of Law. The character <br />of any such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the agreement by the Mayor and the approval of the agreement <br />by the Director of Law. <br />SECTION 2: That this Ordinance shall take effect and be in force from and after the <br />earliest period allowed by law upon its passage and approval by the Mayor. <br />
