CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2021 - 48 <br />By: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF LA W TO <br />EXECUTE ALL DOCUMENTS ON BEHALF OF THE CITY OF NORTH <br />OLMSTED TO AUTHORIZE SETTLEMENT OF CLAIMS ARISING FROM <br />OPIOID LITIGATION, AND DECLARING AN EMERGENCY. <br />WHEREAS, in 2018 the City of North Olmsted declared the opioid epidemic a public <br />nuisance in the City of North Olmsted; and <br />WHEREAS, the City of North Olmsted since 2018 has been a party plaintiff in litigation <br />in the United States Federal District Court for the Northern District of Ohio, Eastern Division <br />seeking damages arising from, among other things, the manufacture, sale and abuse of opioid <br />prescription drugs; and <br />WHEREAS, OneOhio is a state and local cooperative agreement between local <br />governments and the State of Ohio to collectively negotiate settlement terms and to provide a <br />mechanism for allocation and distribution of funds received in settlement; and <br />WHEREAS, the City of North Olmsted, together with hundreds of other governmental <br />entities in Ohio including the cities of Westlake, Rocky River, Fairview Park, Bay Village and <br />Olmsted Falls, are currently participants in the OneOhio cooperative agreement; and <br />WHEREAS, on August 2, 2021, the City received notice of the need to file a OneOhio <br />Participation form for purposes of settlement not later than August 13, 2021; and <br />WHEREAS, the Director of Law recommends that this Council authorize him to execute <br />the OneOhio participation for the purpose of resolving claims presented by the City of North <br />Olmsted in litigation. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Law be and he is hereby authorized to execute all <br />documents, including but not limited to, the OneOhio Participation Form, necessary to resolve <br />and completely settle any and all claims associated with the City of North Olmsted's <br />participation as a party plaintiff in opioid related litigation. <br />
