CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2021 - 67 <br />BY: Mayor Kennedy <br />AN ORDINANCE AUTHORIZING THE MAYOR TO NEGOTIATE AND <br />ENTER INTO AN AGREEMENT WITH THE NORTH OLMSTED <br />BOARD OF EDUCATION TO EXCHANGE SCHOOL DISTRICT - <br />OWNED REAL PROPERTY (PPN 234-21-009) FOR CITY -OWNED REAL <br />PROPERTY (PPN 234-16-004) VIA LAND EXCHANGE AS <br />AUTHORIZED BY OHIO REVISED CODE §3313.40 FOR THE <br />PURPOSE OF ACQUIRING LAND FOR NECESSARY PUBLIC <br />INFRASTRUCTURE IMPROVEMENTS. <br />WHEREAS, CT Consultants site selection analysis for the South Interceptor EQ Tank <br />Project has identified property owned by the City of North Olmsted and the North Olmsted <br />City School District along Stearns Road, west of Spruce School, as the preferred site for a <br />project to alleviate sanitary sewer basement flooding in and around the southwest quadrant of <br />the City; and <br />WHEREAS, of all potential sites reviewed by CT Consultants, this location was best <br />suited considering environmental, geological and hydrological factors and will most <br />effectively reduce sanitary sewer overflows and basement flooding in adjacent neighborhoods; <br />and <br />WHEREAS, the current city -owned land (PPN 234-22-022 and 234-22-023) adjacent <br />to the preferred site identified by CT Consultants is not large enough to accommodate a tank <br />of the size required, approximately 1.5 million gallons; and <br />WHEREAS, the City intends to acquire a portion of the Spruce School property, <br />specifically PPN 234-21-009, the 7.12 -acre parcel west of the school and adjacent to the <br />property currently owned by the City of North Olmsted, for the project; and <br />WHEREAS, in exchange for the 7.12 -acre site owned by the North Olmsted School <br />District, the City proposes to transfer to the North Olmsted School District a 6.17 -acre parcel <br />of city -owned land (PPN 234-16-004) that is landlocked but adjacent to Chestnut School. <br />WHEREAS, the proposed exchange will be mutually beneficial to the School District <br />and the City. First, it will allow the School District to add an additional 6.17 acres to the <br />Chestnut school campus; and second, it will allow the City to acquire and use the 7.12 -acre <br />school property to develop the South Interceptor EQ Tank Project to reduce sewer system <br />surcharges, to address basement flooding; and <br />WHEREAS, there will be no exchange of money for this land exchange and each party <br />
