CITY OF NORTH OLMSTED ORDINANCE NO. 2021 — 73 By: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH CUYAHOGA COUNTY AND THE CUYAHOGA COUNTY COURT OF COMMON PLEAS, JUVENILE DIVISION, WHEREIN THE CITY WILL CONTINUE TO IMPLEMENT A COMMUNITY DIVERSION PROGRAM TO HEAR STATUS, MISDEMEANOR, OR FELONY OFFENSE COMPLAINTS INVOLVING JUVENILES THROUGH DECEMBER 31, 2023, AND DECLARING AN EMERGENCY. WHEREAS, for several years the City of North Olmsted has successfully operated youth and community diversion programs, including those in cooperation with the Court, and with the objective to prevent, control and rehabilitate juvenile delinquency; and WHEREAS, this Council desires to enter into an Agreement with Cuyahoga County, and the Cuyahoga County Court of Common Pleas, Juvenile Division, to participate in the Juvenile Court's Community Diversion Program to hear status, misdemeanor, or felony offense complaints charging juvenile offenders with such offenses; and WHEREAS, the County and the Juvenile Court have recently proposed the attached Agreement, which contains a two (2) year term from January 1, 2022 to December 31, 2023, and contains a stipend for the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to enter into an Agreement with Cuyahoga County and the Cuyahoga County Court of Common Pleas, Juvenile Division, to participate in the Court's Community Diversion Program for charged juvenile status, misdemeanor, or felon), offenses and to receive financial assistance in connection with a Community Diversion Program sponsored by the Cuyahoga County Juvenile Court for the period of January 1, 2022 to December 31, 2023. Said contract shall be substantially in the form of the "Community Diversion Program Agreement," marked as Exhibit "A" and attached hereto. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Resolution go into effect immediately and prior to the expiration of the current contract on December 31, 2021; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
