CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2021 - SS <br />BY: Council President Jones <br />AN ORDINANCE AMENDING AND RE-ESTABLISHING CHAPTER 141.99 <br />OF THE ADMINISTRATIVE CODE, ENTITLED "COMPOSITION AND <br />ORGANIZATION OF THE DEPARTMENT OF PUBLIC SERVICE" IN <br />ORDER TO UPDATE THE ORGANIZATIONAL CHART FOR THE <br />DIVISION OF WASTEWATER (141.99(D)), AND DECLARING AN <br />EMERGENCY <br />WHEREAS, the State of Ohio EPA has amended the Administrative Code to redefine the <br />responsibilities for the Professional Operator of Record and back-up Professional Operators of <br />Records; and <br />WHEREAS, as a result of said EPA changes and a review of the current organizational <br />chart, it become apparent to Superintendent Brian Blum that a change in the organizational chart <br />was in order, to wit: the Chemist position should be at a manager level and the Assistant <br />Superintendent of Maintenance should be reverted to a Maintenance Foreman; and <br />WHEREAS, it is the desire of this Council to implement the organizational changes <br />recommended by Division of Wastewater Superintendent Brian Blum consistent with Ohio EPA <br />standards, all as set forth herein. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 141.99 "Composition and Organization of the Department of <br />Public Service," which presently reads in its entirety as set forth in Exhibit A, which is attached <br />to this Ordinance and incorporated by reference as if fully rewritten herein, shall be amended at <br />141.99(d) and, as amended, Chapter 141.99 shall read in its entirety as set forth in Exhibit B, <br />which is likewise attached to this Ordinance and likewise incorporated by reference as if fully <br />rewritten herein. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re -codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and, <br />additionally, for the further reason that it is necessary that this Ordinance go into effect <br />immediately to ensure efficient and effective operations within the Division Wastewater, and <br />provided it receives the affirmative vote of two-thirds of all members of Council, then it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
