SECTION l: That the Director of Economic and Commmtlity Development be and he is hereby authorized to request proposals from firms qualified to serve as the Cig''s Energy Services Performance Consultant and to provide professional consulting services to the Director of Economic and Community Development in accordance with the Request for Proposals. A copy of the said Request for Proposals is on file in the office of the Director of Economic and Community Development. SECTION 2: That the Mayor be and she is hereby authorized, upon approval of the Board of Control, to enter into an agreement with the finn selected in the RFP process. Said Agreement shall not authorize expenditure of funds, except as otherwise appropriated therefore, and shall provide the Fnergy Services Performance Consultant be compensated in connection with utility cost savings actually realized upon implementation of energy conservation measures or reduced energy consumption. In the event that no enemy conservation measures are implemented, nor costs or consunnption otherwise reduced, the Agreement tnay provide for payment not in excess of $2.500 to conduct an energy performance audit. Said agreement shall be presented to the Director of Law in form or in substance that are not Substantially adverse to the City and which are approved by the Director of Lacy. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law. SECTION 3: That this Ordinance is herebv enacted pursuant to, and desiened to implement, Section I I I of the Codified Ordinances of North Olmsted and nothing herein shall authorize the City or the Energy Services Performance Consultant to make any expenditure. purchase, procurement, or puhlie improvement project, by construction contract or otherwise. unless authorized by the City Council. SECTION 4: That this Ordinance shall take effect and be in force from and after the earliest date provided by law.
