CITY OF NOR 111 OLMSTED <br />ORDINANCE NO. 2022 - 42 <br />BY: Mayor Jones; Council President Brossard. Council Members Scarf. (ilassburn, Hemann <br />KeLb. Limped, and Williamson <br />AN ORDINANCE OPTING OUT OF HOUSE BILL 172 HLB. 172) AND <br />BANNING THE DISCHARGE, IGNITION OR EXPLOSION OF <br />FIREWORKSIN THE CITY OF NORTH OLMSTED, AND DECLARING AN <br />EMERGENCY <br />WHEREAS the Ohio General Assembly enacted I1.13. 172 allowing private <br />individuals to discharge. ignite or explode fireworks on private property on certain days of <br />the year: and <br />WHEREAS, I I.B. 172 provides for and enables municipal corporations to determine <br />whether to opt out of these changes in State law and to continue to enforce local laws that <br />have and continue to ban the discharge, ignition and explosion of fireworks which may <br />otherwise be permitted pursuant to H.B. 172: and <br />WHEREAS, the City Council has determined that it is in the best interest of the City' <br />of North Olmsted to continue to prohibit or ban the discharge, ignition and explosion of <br />fireworks in the C'.ity of North Olmsted which may otherwise be pennittcd pursuant to 11.11. <br />172. <br />:YON', THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THF. CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF01110: <br />SECTION I: that the discharge, ignition or explosion of fireworks otherwise <br />permitted by ILB. 172 is hereby prohibited and tanned within the City of North Olmsted and <br />remains regulated by Chapter 1719 ofthe Codified Ordinances. <br />SECTION 2: 1 hal any ordinance, or pan of ordinance. in conflict or inconsistent with <br />this Ordinance. is, to the extent of amsuch conflict or inconsistency, repealed.
