CH Y OF NORTH OLMSTED <br />ORDINANCE NO. 2022 - 26 <br />Bv: Mawr Jones <br />AN ORDINAN'CF CREATING NEW SECTION 1139.13 ENTITLED <br />"PHASED DEVELOPMENT" OF CHAPTER 1139 OF THE <br />PLANNING AND ZONING CODE OF THE CODIFIFD <br />ORDINANCES OF THE CITY OF .NORTH OLUSTED ENTITLED <br />"BUSINESS DISTRICTS" FOR THF PURPOSE OF AUTHORIZING <br />PHASED DEVELOMENT PLANS IN NORTH OLMSTED BUSINESS <br />DISTRICTS. <br />WHEREAS. as presenlly enacted in the planning and Zoning Code, the code authorizes <br />phased development in Residential 011lce developments (§1142.12), Multiple Residence <br />developments (§1137.13), Senior Residence developments (§1138.13), and Mixed Use <br />developments (§I 149.04) but not in Business Districts (§1139): and <br />WHEREAS, the administration believes that establishing a process for phased <br />devcloptnents in Business Districts would provide greater Ilexibility to developers seeking to <br />develop or re -develop tracts of land that are zoned within the zoning classifications established in <br />Section 1139: and <br />WHEREAS, billowing publication of newspaper notice in conformance with the <br />provisions of Section 14 of Anicle IV of the Charter and Section 1127.03 of the planning and <br />Zoning Code. a public hearing was held on the; 'P` day of 00 . 2022; and <br />WHF_REAS. it is the desire of this Council to amend the Zoning Code. all as recommended <br />ti the Economic and Community Development Director, in order to authorize phased development <br />in Business Districts. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THF_ CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OFOHIO: <br />SECTION 1: that there is established a new Section 113213 entitled "phased <br />Development' of Chapter 1139 of the Planning and Zoning Code of the codified ordinances of <br />the City of North Olmsted entitled "Business Districts' which shall read in its entirety as Ibllows: <br />1139.13 Phased Development <br />A dcwloper, having obtained final approval of a development site plan or conical porancousl. <br />Stith such approval. ma} accomplish the devclopnacnt in prouresskc aagcS subject to such terms <br />and conditions as mac he established by the planning and Design ('onnnission and Cit -N Council. <br />
