AUTHORIZING THE MAYOR TO NEGOTIATE AND ENTER INTO AN AGREEMENT WITH THE NORTH OLMSTED BOARD OF EDUCATION TO PURCHASE SCHOOL DISTRICT -OWNED REAL PROPERTY COMMONLY KNOWN AS FOREST ELEMENTARY SCHOOL AND SPRL'CE ELEME'NTARYSC'HOOL IN CONSIDERATION OF FOUR MILLION DOLLARS. WHEREAS. the Board of Education of the North Olmsted Cite School District, an Ohio public school district and political subdivision ('School District"), o0ces to sell and the City of North Olmsted propose to purchase Forest Elementary School and surrounding properties. approximately 12.05 arcs, described as PPN 233-26-063. and 064. and 065. and Sprues Flemeatary School and surrounding properties. approximately 13.34 acres, described as PI'N 234 27-064 and 234-27-066, in consideration of payment in the amount of Four Million Dollars ($4.(111(.000.00) and other considerations; WHEREAS. it is the desire of Council to authorize the Mayor to negcniate and enter into an Agreement with the School District In purchase Forest Elementary School and Spruce Hementap- School pursuant to and consists it with the terms and conditions outlined in the Aerceutent. attached as Exhibit A. NOW, THEREFORE., BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUY IIIOGA, AND STATE OF CIAO: SECTION L That the Macon and Director of Lmv be and are hereby authorised to negotiate and enter into an agreement with the North Olmsted City School District Ior the purchase Forest Vlcrnentan° School and surrounding properties. approximately 12.05 acres. described as PPN 23',-26-063- and 064, and 065, and Spruce Idententary School and surrounding properties, approximated, 12.34 acres, described as pFN 234-27-064 and' -34-27- 066. in consideration of payment in the amount of Pour Million Dollars ($4900,000.00) and other considerations, based on and consistent with the Agreement attached a- Iixhibit A. SECTION 2: That the Agreement with the 'forth Olmsted Board of Education shall be in the form and substance as on file with the Department of Law, with such changes in form and substance that are not substantiall, adverse to the Cit} and which are approved by the Director of Law. The character of the agreement as not being substantiall% adverse to the City shall he evidenced conclusi%cly he the execution of the agreement by the Mayor and the approval of the contract by the Director of Law.
