SECTION 2: 1 hat the Director of Public Safety be and she is hereby authorized <br />to proceed with, negotiate contracts for. and initiate all reasonable measures, either <br />directly or through authorized agencies. including cooperative agreements with the <br />Cuyahoga County Land Bank, to demolish and remove all unsafe and dangerous <br />buildings located at 28757 Oring Drive- City of North Olmsted, as necessary to abate said <br />public nuisance pursuant to Chapter 1363 and 1364 of the Codified Ordinances, and <br />further authorizing the Mayor to enter into said agreements for demolition service. <br />including with the Cuyahoga County Land Bank, to raze structures, which contract shall <br />be in a legal form and contain substance deemed necessary by the Director of Law. The <br />character of any such contract as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the Agreement by the Mayor and the <br />approval of the Agreement by the Director of Law. <br />SECTION 3: That the Clerk of Council be and she is hereby directed to forward <br />a copy of this Ordinance by certified mail to the property owner, lienholders and all other <br />persons having an interest in the property, as the names and addresses appear in the <br />records of the Building Commissioner. <br />SECTION 4: 1 hat the Clerk of Council he and she is hereby directed, with the <br />assistance and direction of the Director of Finance and the Director of Law, to certify the <br />entire cost of demolition, including the cost of service, all interest and penalties allowed <br />by law. together with a proper legal description of the premises at 28757 Oring Drive, <br />North Olmsted, Ohio to the office of the Cuyahoga County Fiscal Officer. which shall <br />thereby constitute a tax lien vested and granted priority pursuant to Ohio Revised Code §§ <br />715.26 and 715.261. <br />SECTION 5: That this Council authorizes the expenditure of funds and hereby <br />appropriates same for the expenditures relating to the subject demolition and removal <br />service contract and hereby approves payments to be made by the Director of Finance <br />that are consistent with the provisions of this Ordinance. <br />SECTION 6: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />lir the further reason that it is necessary that this legislation be effective immediately so <br />that the public nuisance can be abated by the City expeditiously, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />TdSS/s2 ..
