CITY OF NORTH OLMSTED ORDINANCE: NO. 2022 -97 Bv: MavorJones AN ORDINANCE AMENDING THE SCHEDULE OF USES AT 1139.03-1 OF CHAPTER 11.39, "BUSINESS DISTRICTS" OF THE PLANNING AND ZONING CODE OF THE CODIFIED ORDINANCES OF THE CITY OF ,NORTH OLMSTED, FOR THE PURPOSE OF ESTABLISHING MASSAGE ESTABLISHMENTS OPERATED BY STATE LICENSED PROFESSIONALS AS A PERMITTED USE IN THE NORTH OLMSTED BUSINESS DISTRICT. WHEREAS, upon review. the Director of Economic and Community Development is of the opinion that Chapter 1139 should be updated to include regulations for massage establishments: and WHEREAS, it is the recommendation of the Director of Economic and Community Development that the City Council expand the table of uses at 1 139.03-1 of Chapter 1139 of the Planning and Zoning Codc to include stale licensed massage establishments; and WHEREAS, following publication of newspaper notice in conlbrmance with the provisions of'Section 14 of Articl , IV ul th• Charter and Section 1127.03 of the Zoning Code, a public hearing was held on the y day of x.2022: and WHEREAS, it is the desire of this Council to amend Planning and Zoning Code Chapter 1139.03 in order to authorize message establishments as a permitted use in the Business District. subject to additional regulations in the Codified Ordinances. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION l: [hat the Schedule of Uses set forth at table 1139.03-1 of Chapter 1139 of the Planning and Zoning Code of the Codified Ordinances of the Cit- of North Olmsted. as set forth in the attached and incorporated Exhibit A, shall be amended and as amended and shall read as set forth on Exhibit A. with such amendments noted by bold lace text Massage Establishments- as listed under "OfEce and Services.` SECTION 2: 1 hat the Clerk of Council be and she is hereby directed to cause notice of a Public I Tearing hereon to he given pursuant to the provisions of Section 14 of Article IV of the Charter ol'the City of North Olmsted and Section 1127.03 of the North Olmsted Zoning Code.
