Additional Instructions to Bidders 1) _Rejection or Acceptance of Bid The City of North Olmsted reserves the right to reject any or all bids, and any part of any bid, and, also the right to waive any infornalities in the bid. In awarding a contract, the City reserves the right to consider in addition to price and discount, all elements entering into the question of determining the ability of the bidder to perform the contract satisfactorily. All materials presented as a "substitute" should be entered on the proposal substitution sheet. Acceptance of the proposal of any bidder by the City shall not constitute an agreement between the City and such bidder and shall not be binding upon the City unless and until an agreement covering all conditions and provisions of the work to be performed by the successful bidder has, at the time of/or after the acceptance of such proposal, been reduced to writing and executed by both the City and successful bidder. 2) Acceptance of b;guipment The turf sprayer delivered under this bid shall remain the property of the bidder and shall not be paid for until physical inspection and actual usage of the turf sprayer is made, and thereafter accepted to the satisfaction of the City and must comply with the terms herein, and he fully in accord with the specifications. In the event the turf sprayer supplied to the City is found to be defective, or do not conform to the specifications, the City reserves the right to cancel the contract. 3) Brand Names If and whenever in the specifications a brand name, make, name of any manufacturer or trade name is mentioned, it is for the purpose of establishing a grade of quality of the equipment only. The City does not wish to rule out competition and equal brands or makes. However, if a product other than that specified is bid, it is the bidder's responsibility to name such a product within its bid and prove to the City that said product is equal. All bidders are required to submit brochures, samples and/or product specification details on the item(s) bid. The City shall be the sole judge concerning the merits of bids submitted. 4) Delivery a) All bidders must guarantee delivery of the turf sprayer bid. Desired delivery date is no later than 2023 calendar year. The City reserves the right to cancel such contracts or part thereof, without obligations- if delivery is not made at the time specified. b) Turf sprayer shall be delivered to Springvale Golf Course at 5871 Canterbury Road, North Olmsted. Ohio 44070. 5) Location of Vendor The City reserves the right to give consideration to the vendor location in determining the lowest and best bidder if future warranty repair or administrative cost would necessitate any travel or additional expense that must be paid by the City.
