CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2023-27 <br />By: Mayorloncs <br />AN ORDINANCE AUTHORIZING TOE MAYOR TO ENTER INTO A FIVE <br />(5) YEAR LEASE AGREEMENT WITH MOTOROLA TO INSTALL <br />DISPATCHER'S CONSOLE MODEL MCC -7500E, THROUGH THE STATE <br />PURCHASE PROGRAM, AT AN ANNUAL COST OF $/62,288.49 AND <br />FURTHER AUTHORIZING THE MAYOR TO EXECUTE CONTRACT <br />DOCl/MENTS, AND DF_CL ARING AN EMERGENCY. <br />WHEREAS, the Director of Puhlic Salety has recommended that the City of North <br />Olmsted enter into a five (5) year lease agreement with Motorola to acquire use of a Model <br />MCC7500F console for the 'North Olmsted Dispatch Center, together with related software and <br />technical support services. to enhance public safely for anergency calls to Police and ]'he: and <br />WHEREAS, Council has, by separate legislation, addressed the costs and appropriations <br />for this expenditure, which is authorized without public bidding through the State Purchase <br />Program, and with Motorola being the sole source provider in the State of Ohio: and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter in a live (5) <br />year lease agreement with Motorola, at an annual cost of $162.288.49 subject to review of Icgal <br />forth by the Director of Law. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY Of,- <br />NORTH <br />I'NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: that the Director of Public Safely be and she is hereby authorized to <br />acquire through the State Purchasing Program. which was established by O.R.C. Section 125.04, <br />and which the City is authorized to participate in pursuant to the City Charter and Resolution No - <br />87 -6. a model MCC7500R dispatch console, together with related software and technical support, <br />as detailed by proposals on file. at a cost of $731.134.00, payable in annual installments of <br />$162288.49 via a five (5) year ]case agreement with Motorola. Said Agreement shall be in the <br />form and substance as on the in the Department of Public Safehr. with such changes in form and <br />substance that are not substantially adverse to the City and which are approved by the Director of <br />Law. The character of the agreement as not being substantially adverse to the Cit- shall be <br />evidenced conclusively by the execution of the agreement by the Mayor and the approval of the <br />contract by the Director of Law. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary fm' the preservation of the public health, safety and welfare, and further <br />1'or the reason that it is necessan that this Ordinance go into effect itnmediatcly to avoid <br />anticipated price increase and/or supph chain delays: and further provided it receives the <br />
