enforcement actions by Building officials, that a public nuisance at 24094 Frank St., <br />North Olmsted OH 44070 (detached garage only), must and shall be abated by <br />demolition of said unsafe structure (limited to detached garage only) as necessary to <br />protect the health, safety and general welfare of the citizens. <br />SECTION 2: That the Director of Public Safety be and she is hereby authorized <br />to proceed with, negotiate contracts for, and initiate all reasonable measures, either <br />directly or through authorized agencies, including cooperative agreements with the <br />Cuyahoga County Land Bank, to demolish and remove the detached garage structure and <br />only the detached garage, as an unsafe structure and public nuisance, located at 24094 <br />Frank St., City of North Olmsted, OH (PPN 231-23-026), and further authorizing the <br />Mayor to enter into said agreements for demolition service, including with the Cuyahoga <br />County Land Bank, to raze only the unsafe structure, (limited to the detached garage), <br />which contract shall be in a legal form and contain substantive terms deemed necessary <br />by the Director of Law. The character of any such contract as not being substantially <br />adverse to the City shall be evidenced conclusively by the execution of the Agreement by <br />the Mayor and the approval of the Agreement by the Director of Law. <br />SECTION 3: That the Clerk of Council be and she is hereby directed to forward <br />a copy of this Ordinance by certified mail to the titled property owner, lienholders and all <br />other persons having an interest in the property identified at 24094 Frank St., North <br />Olmsted, (PPN 231-23-026), as the names and addresses appear in the records of the <br />Building Commissioner. <br />SECTION 4: That the Clerk of Council be and she is hereby directed, with the <br />assistance and direction of the Director of Finance and the Director of Law, to certify the <br />entire cost of demolition, including the cost of service, all interest and penalties allowed <br />by law, together with a proper legal description of the premises at 24094 Frank St., North <br />Olmsted, Ohio (PPN 231-23-026) to the office of the Cuyahoga County Fiscal Officer, <br />which shall thereby constitute a tax lien vested and granted priority pursuant to Ohio <br />Revised Code g§ 715.26 and 715.261. <br />SECTION 5: That this Council authorizes the expenditure of funds and hereby <br />appropriates same for the expenditures relating to the subject demolition and removal <br />service contract and hereby approves payments to be made by the Director of Finance <br />that are consistent with the provisions of this Ordinance. <br />SECTION 6: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is necessary that this legislation be effective immediately so <br />that the public nuisance can be abated by the City expeditiously, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />
